To gn of 1YMS1,1ee <br />16 Gr wt =Heck. , Oad « `61-tla . <br />MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />AUGUST 9, 2017 <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, August 9, <br />2017 at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road <br />North. Chairman, Jonathan D. Furbush, Board Members William A. Blaisdell, Ronald <br />Bonvie, Scott Goldstein, and Associate Members, Brad Pittsley and Norman J. Gould were <br />present. Building Commissioner, Michael Mendoza was also present. Board Member, Dom <br />DeBarros was absent. <br />PLEDGE OF ALLEGIANCE <br />CONTINUED HEARINGS <br />Chairman Furbush addressed the applicant explaining that there were only four (4) Board <br />Members to hear his petition. As with every case, four positive votes are required for the <br />petition to pass. When five (5) Board members are present, you can have one negative vote <br />and four positive votes and the petition will pass. When there are only four (4) Board <br />members present, all four members have to vote positive in order for the petition to pass. <br />He gave the applicant the opportunity to continue the hearing. <br />Mr. Furbush and Scott Goldstein both recused themselves from this case. <br />29 Ouippish Road: Owner, Philip A. Hall, requests a Special Permit under §174-45.4 of <br />the Zoning Bylaws to allow for an accessory apartment on property located in an R-3 <br />Zoning District, (Map 55 Parcel 5.0), Mashpce, MA. (Continuer) from July 26, 2017 <br />hearings at the request of the applicant). <br />Mr. Philip Hall returned to present his application and provided the Board with the <br />information they requested at the last hearing on July 26, 2017. He provided a first floor <br />plan, a second floor plan, and the site plan that shows the parking. Mr. Hall was asked to <br />show the smoke detectors and the CO detectors for the entire living space within the home. <br />He said they were already inspected by a fire inspector. <br />Vice Chairman, Bill Blaisdell said that there are several items that need to be addressed <br />that were discussed at the last hearing. The total square footage of living space for the entire <br />property, and the regulations for the accessory apartment must have at least 300 sq. ft. of <br />living space, but not more than 40% of the total living space of the accessory apartment. <br />The plan shows the 484 sq. ft. which is far less than the 40% of the 716.80 sq. ft. Mr. <br />Blaisdell had a conversation with the Building Commissioner and it was determined that <br />the living space should be the actual living space and not the footprint of the building, thus <br />this proposal is in compliance with the square footage to have an accessory apartment, <br />therefore this proposal is in compliance with the square footage to have an accessory <br />apartment. <br />1 <br />
