MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />AUGUST 9, 2017 <br />Mr, Robert Bortolotti, Owner of Bortolotti Construction represented himself for the Special <br />Permit request. He is the operator of the property located at 118 Echo Road. He believes <br />his business use is appropriate for the Industrial Zoned location and is consistent with the <br />abutters in that area. His operation has been in existence since 1995 and he was asked to <br />go before the Town due to the runoff of dirt in the road way during wet conditions, and he <br />was asked to explain what type of operation was causing this to happen. <br />Mr. Bortolotti met with the DPW and the Building Commissioner who expressed their <br />concerns, and he believes that he is mostly in compliance. He said that the apron is being <br />installed, and he is willing to comply with any other requests. He also met with Glen <br />Harrington, at Board of Health who expressed his willingness to help him apply for the <br />DEP application for the General Permit for composting. <br />Mr. Bortolotti said he's been leasing the property since 1995 prior to the Town paving the <br />road, and while in operation he did not know that permitting was required. So he is asking <br />for rightful permission to continue his business. <br />Mr. Furbush noticed that there was an error with the advertisement for the bylaw being <br />listed as §174-25 F (13), and confirmed that it should but should be §174-25 G (13). He <br />wanted to know if this would cause an administrative issue. The Building Commissioner <br />did not believe this would have any impact because the intent as it is advertised is a Special <br />Permit request. It would make more of a difference if it were advertised as a Variance <br />request.. <br />The Building Commissioner addressed the Board and said that the applicant's request went <br />before the Plan Review Board to discuss the business and the water runoff issues. At the <br />time when the Town had taken over Echo Road, everyone was going through there <br />paperwork and somehow while doing their due diligence they noticed that their paperwork <br />had fallen through the cracks and it is just now being corrected. <br />Mr. Furbush read the bylaw §174-24 C2 into the record so the Board and audience are <br />familiar with what to look at when these requests are brought in front of the Zoning Board. <br />Mr. Goldstein read the Board of Health comments into the record. <br />Mr. Furbush read the Inspection Department and the DPW comments into the record. <br />Mr. Bortolotti said he will absolutely comply with all the conditions. <br />There were no more comments from the Board or audience. <br />h <br />
