MASHPEE ZONING BOARD OF APPEALS <br />JANUARY 13, 2016 <br />MINUTES <br />Mr. Furbush read the Inspection Department comments into the record; "The area is zoned <br />R3 and is in the Popponesset Overlay District and is also in the Pre -contact Archaeology <br />Sensitivity area— listed as "Moderate Sensitivity". The applicant is seeping a Written Finding <br />under Article V §174-17 regarding a determination from the Board if the removal of the <br />existing home and replacing it with a new single family home would increase the non- <br />conforming nature of the home. <br />Mr. Furbush read the Board of Health comments into the record; "The proposed floor plans <br />have been reviewed and are acceptable for three bedrooms. The septic tank is proposed to be <br />replaced with a variance that still makes the septic in more compliance than before. The <br />leaching facility is to be inspected prior to building permit issuance. The demolition checklist <br />will be required to be completed and submitted prior to demo permit issuance." <br />Mr. Blaisdell made a motion to approve the project with the following conditions; <br />1. The Board has determined that the applicant meets all the conditions of a Written <br />Finding under Mass General Law 40A Section 6. <br />2. Plan of Land to Accompany a Finding of Fact Application at #28 Elliot Road, <br />Mashpee, Massachusetts. All <br />were in favor of the raze and replace project. <br />OTHER BUSINESS <br />58 Echo Road -Lou and Anne Seminara to address minor modifications to existing pen -nit, <br />Mr. Mendoza explained to the Board and audience that there was a meeting at Town Hall <br />with the owners to discuss the building project issues regarding the paving and stripping at <br />the site. The owners posted a bond to the Town.. Mr. Mendoza explained that he was not <br />given any leeway to let the owners know if they could complete a portion of the project, and <br />to follow the approval process. <br />5 <br />
