Acting Chairman, William A. Blaisdell, Board Members, Ronald Bonvie,
Dom DeBarros, and Scott Goldstein, and Associate Members, Brad Pittsiey and Norman
J. Gould were present. Chairman Furbush was absent.
PLEDGE OF ALLEGIANCE
Mr. Blaisdell opened the meeting announcing that it was being televised live on Mashpee
TV.
36 Valley Road: Owner, Sally A. Lewis requests a Special Permit under § 174-45.4 of the
Zoning By-laws to allow for an accessory apartment above an existing garage located in
an R-5 Zoning District, Map 42 Parcel 4, Mashpee, MA. (Continued from November 9,
2016 hearings at the request of the owner, opened but not beard).
Attorney Kevin Kirrane represented the homeowner for the accessory apartment
application. He provided the Board with his written remarks and photographs of the
property, both exterior and interior. He said the property is situated in the Ashumet Shores
subdivision that was established in 1965, and is on a lot that consists of 12,600 sq. ft. with
120 feet along Valley Road.
Ms. Lewis purchased the property in 2001, and at that time, thought the apartment above
of the attached garage was valid, but recently learned that it was not properly permitted so
she is now seeking the appropriate special permit to establish that apartment above the
attached garage.
Attorney Kirrane said that the Board is well aware of the specific criteria in the bylaws that
must be met to establish a Special Permit for an accessory apartment. He said this
application meets all the requirements as listed in his written remarks. He respectfully
asked the Board to act favorably upon the special permit request.
Mr. Bonvie asked if the applicant appeared in front of the Design Review Board. Attorney
Kirrane said he was not aware if that happened, but thought if there were construction
involved it may have required a meeting with Design Review. He said this is a building
that has existed for 20 -plus years, and no exterior modifications are proposed.
Mr. Bonvie read the Inspection Department comments into the record, and the Board of
Health comments into the record.
