Esposito <br /> requesting a written Finding under Article V §174-17 of the Zoning Bylaws to allow for <br /> construction of a retaining wall on property located in an R-3 Zoning District at 25 Sand <br /> Dollar Lane, Map 105 Parcel , Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication to The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on January 23, 2015 and January 30, 2015 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Daws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on February <br /> I 1? 2015 at wh1ch time the fo I I ow Ing m embers o f the Board o f Appeal s were present; Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, James Reiffarth, Richard <br /> J dl a, and Associate Members, Dora D Barros, and Scott Goldstein. Also present was <br /> Building Commissioner, Michael Mendoza. <br /> Mr. Darrell Chapman, represented the Petitioner to construct a curved "bump out" <br /> retaining wall. The existing wall is two 2 feet tall and two feet wide fora total of four <br /> (4) feet and is 10 to 12 feet from the coastal bank. He plans to demo the wall and install a <br /> locking block wall. He will be meeting with Conservation on February 121h. The reason he <br /> is before the Board is because the height of the wall requires a building permit. The Board <br /> determined the project is not substantially detrimental to the neighborhood. <br /> GENERAL CRITERIA ■ <br /> The subject prop erty located at 2 5 Sand Dollar Lane is appro ximatel y 11,452 square <br /> feet. <br /> There were no abutters present. <br />� 1 <br />
