Silliman requesting <br /> written Finding under Article v §174.17 o f the Zoning Bylaws to allow for construction <br /> o f a deck n prprty located in an R-3 Zoning District at 3 5 Wilsons Grove, (Map 11 <br /> Parcel 87 , Mashpee, IIIA. . <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The 1 lashpee Enterprise, a newspaper of <br /> general circulation in the Town of M shpee, on Januar} 23, 2015 and January 30, 2015 a <br /> copy hi h is attached hereto and made a part hereof. <br /> The Il ashpee Zoning Board ofAppeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of M shpee <br /> ZoningBy-laws. <br /> Public Hearings were held on the Petition at the Ilashpee Town Hall on February <br /> 11, 2 015at whi ch time the following membders ofthe 1oard ofAppeals were present- Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, James Reif arch, Richard <br /> Jodl a, and Associate Members,rs, Dom De arr s, and Scott Goldstein. Also present was <br /> Building Commissioner, Michael Mendoza. <br /> Ms..Jean Bowden, of Capizzi Horne Improvement Inc., represented the Petitioner <br /> proposing to rebuild the 8' x 12" rear deck with a 10' x 20' in the Popponesst Overlay <br /> District. The home is pre-existing, non-conforming in the setbacks on the right side facing <br /> the street. The lot coverage is currently 22.5%, and would increase to 24.8%. The allowed <br /> lot coverage in this District is %. The project was approved her Conservation <br /> Commission ori Januar} 22, 2015. The Board suggested the applicant remain within the lot <br /> coverage and construct a patio with one step down ground level, or rebuild the deck in the <br /> same dimensions. The Board concluded that the applicant request a withdrawal without <br /> prejudice due to the increase in lot coverage. <br /> In view of the foregoing, the Board voted unanimously to accept the Petitioner's <br /> request to withdraw without prejudice of a written Finding. Upon duly made and <br /> seconded at the Public Hearings on February 11, 2015. <br /> 1 <br />
