Town of Mashpee <br />16 Great Neck Road North <br />Mashpee, Massachusetts 02649 <br />BOARD OF HEALTH - PUBLIC SESSION <br />Minutes of the Meeting of September 17, 2015 <br />Board Members Present: Member Absent: Also Present: <br />Burton Kaplan, Chairman Kalliope Egloff, Co -Chair Glen_ Harrington, Health Agent <br />Lucy Burton, Clerk <br />Chairman Burton Kaplan called the meeting to order at 7:03 PM. <br />APPOINTMENTS <br />7:15 PM — Barbara Keen — Variance Request to Local BOH Regulations -- 98 Cape Drive. <br />Patty Flynn, a realtor with William Raveis, representing Barbara Keen of 98 Cape Drive, introduced herself to <br />the Board. <br />Ms. Flynn remarked that Barbara Keen is requesting a variance from the Septic Inspection Regulation because <br />the septic tank is five feet below grade. Ms. Flynn provided photographs of the septic tank taken during the <br />septic inspection to the Board of Health. <br />Glen Harrington commented that the septic inspection revealed the leaching system it 98 Cape Drive had <br />failed and will need to be upgraded. Also, the septic tank is five feet below grade, and the Board of Health <br />regulation requires replacement if the tank is more than four feet below grade. Mr. Harrington feels that since <br />the leaching system is to be replaced, it would be worthwhile upgrading the septic tank to prevent any hazards. <br />Lucy Burton made a motion that the Board of Health deny the variance request for 98 Cape Drive based upon <br />the age of the septic tank and the necessity to have the 1500 gallon H-20 loading septic tank replace the old <br />1000 gallon H-10 septic tank and to maintain the three feet of cover. Burton Kaplan seconded the motion. The <br />motion was unanimously approved. <br />NEW BUSINESS <br />1. Sign Expense Warrants. The Board members signed the expense warrants. <br />2. Review/Approve BOH Public Session Minutes September 3, 2415. <br />Lucy Burton made a motion that the Board of Health approve the Public Session minutes of September 3, <br />2015, as amended. Burton Kaplan seconded the motion. The motion was unanimously approved. <br />OLD BUSINESS <br />1. Compliance Review: 42 Wheeler Road. <br />Glen Harrington stated that he spoke to the previous owner of 42 Wheeler Road. The previous owner had <br />money held in escrow to design and install the septic system. The septic system has been installed, but the <br />Certificate of Compliance will not be issued until the Installer's and Engineer's As Built Cards are submitted to <br />the Health Department. When the property was transferred, a Title V Inspection was not performed, and it has <br />been more than two years since the date of transfer that the septic system had been installed. <br />Mr. Harrington is recommending daily fines of $250 until the Certificate of Compliance is issued. <br />
