k <br /> Assessor's Report—John Duffy <br /> How the Town of Mashpee Handles Taxation of Condominium Development Rights <br /> John Duffy stated that development ri hts are taxed. The development right has economic value and <br /> therefore it is reasonable to tax such a right. Condominium developments normally are built in <br /> several phases. The condominium expansion land is common area of the condominium and as such <br /> is taxed pro rate to the current owners in the condominium. For that reason, common areas may not <br /> be taxed other than proportionately to the unit owners.- The law states that each unit and its interest <br /> in the common areas and facilities shall be considered ars individual panel of real estate for the <br /> assessment and collection of real estate taxes, but the common areas and facilities, the building and <br /> the condominium shall not be deemed to be a taxable parcel. Even if real estate subject to <br /> development rights is apart of the con dorniniurn and lawfully'owned' by the unit owners in com mon, <br /> it is in fact an asset of the developer. <br /> NEW BUSINESS <br /> Real Estate Property Tax Abatement Approvals. Jason Streebel made a motion to approve the <br /> eighteen 1 real estate property tax abatement applications listed on State Tax Form 155, dated <br /> 3/21/06, beginning with the name Mills Brennan Emma Jo and ending with the name EYs Music Art. <br /> (See Attachment A for Fell Listings). Marcia King seconded the motion. All approved. <br /> Real Estate Property Tax Abatement Denials. Jason Streebel made a motion to deny the eleven <br /> (11) read estate property tax abatement applications listed on State Tax Foran 155, dated 3!21/06, <br /> beginning with the name !'!!Mills Brennan Emma Jo, and ending with the name Danforth, Steven P <br /> .loan P. (See Attachment B for Full Listings). Paul Andrews seconded the motion. All approved. <br /> Personal Property Tax Abatement Approvals. Jason made a mobon to approve the two 2 <br /> residential personal property tax abatement applications listed on Mate Tax Form 155, dated 3/21/06, <br /> for Deluca Merope, Greenwood Development corp, and the one 1 commercial personal property tax <br /> abatement application listed, for EJ's Music Art. (See Attachment A for full listing). Marcia King <br /> seconded the motion. All approved. - <br /> OTHER NEVA BUSINESS <br /> Personal Exemption Approvals. Jason Streebel made a motion to approve the following two 2 <br /> senior personal exemption applications: <br /> Carol Glazier, 12 Bluff Avenue <br /> llecla§1hritenour, 15 Driftwood Way <br /> Marcia Icing seconded the motion. All approved. <br /> NEXTUEETII <br /> The next meeting was scheduled for Tuesday, April 18, 2006, at 5:45 PNM, Mashpee Town Hall <br /> Assessor's office.
