Rowley <br /> Also Present : Town Planner Tom Fudala <br /> TIME: : 10 PM <br /> An Approval Eot Required plan which was submitted at the last meeting <br /> by Sarah & Rebecca Lard Co .' was continued to tonight . They were <br /> represented by Atty, Gessner, Mr. Devaney and Steven Doyle , <br /> Att , Lessner said at the last meeting they didn't have a. completed plan <br /> but a sketch . This time they had a plan eliminating the curb cuts and <br /> put in an access road , easement , He said they eliminated a parcel that <br /> was defined and made it a ballpark, He said they had agreed to continue <br /> the meeting and a determination is to be rade tonight if it 's an AN <br /> plan. He said it Falls under the Planning Board 's rules and regulations <br /> and town zoning . <br /> Mr. Dubin said Town counsel had reviewed the plan and said the original <br /> plan used to establish the Approval Not Required wasn't approved i <br /> accordance with the subdivision control law as - it didn't have a covenant <br /> attached . <br /> Ater. eser said they have found the covenant and presented it . <br /> MIn . Dubin said the roads would have to be brought up to subdivision <br /> standards . Atty. Lessner said the feeling is they'll have to do it if <br /> dictated but didn't feel it was required , but he will bring it up to <br /> Mr. Devaney to do it . He went on to say the Board had agreed they would <br /> take a vote tonight . Mr. Marsters said the plan submitted was not a <br /> proper plan as there was no information of the covenant on it and as the <br /> Board was just given new information, they have 14 more days to look at <br /> it . <br /> Atty.. Gessner disagreed. He said they were told to improve the entrance , <br /> they did it and at that point agreed to extend it for 2 weeks and resubmit <br /> the plan, - <br /> r . Dubin said the Board had been unhappy from the beginning about the <br /> condition of the road , They had suggested panhandling the lots so they <br /> don't have a gravel driveway off of Rte . 151 . Mr. Dubin took comments <br /> fPom the public , <br />
