<br /> To see if the Town will vote to authorize the Selectmen to acquire, by purchase or
<br /> other-wise, for conservation acid passive recreation purposes, consistent with the
<br /> provisions (AMa s. Gen. Laws. Ch- 40, Section 8C, and Afticle 97 of the Amendments to
<br /> the Constitution of the Commonwealth of Massachusetts, the collection of parcels of land
<br /> know as the "Dacey roper-ties" identified on the 2007 Ma tepee Assessors' Maps as 1
<br /> parcels amounting to 38 acres located between Algonquin Avenue, old Barnstable road
<br /> and Nathan 8111s Highway (Parcel IDs- 72 117 0), (72 113 0), (72112 0), (7211 1 0), 7
<br /> 110 0 , 79 80 0 , 79 79 7 79 78 0 , 79 77 r (79 76 0 , 79 75 0 , 79 73 0 , 79 7
<br /> 0), 79 72 ) 79 71 0. ; 1 18 , and further, to see if the Town wilI vote to raise.and
<br /> appropriate., of transfer from available funds, $5,619,300 for such purpose, including
<br /> expenses incidental and related thereto, and to raise such appropriation, the Treasurer,
<br /> with the approval of the Torn, be authorized to borrow $5,619,300 or any other sum
<br /> under and pursuant to Chapter 44, Sections 7 and 8C and, if applicable, Chapter 40,
<br /> section 8C of the General laws, or any other enabling authority, and to issue bonds or
<br /> notes of the Town therefore, with said borrowing to be repaid with funds from the Land
<br /> Sant Fund established by the Town under the provisions of Chapter 293 of� e Acts of
<br /> 1998 An Act Relative to the Establishment- of the Cape Cod Open Space ace Land

<br /> Acquisition Program)} and further, to see if the Town will authorize the Board o
<br /> Selectmen and or Conservation Commission to apply for and accept Federal, State and
<br /> or County grants, inclutding reimbursement under Chapter 132A, Section 1I of the
<br /> General Lars, the "Self-Help Act", and/or the Federal Land &. water Conservation Fund,
<br /> P.L, 88-56810 78 Stat 897, to be applied by the Town. toward the financing of this
<br /> purchase, and to eater into contracts or agreements with Federal, Mate and/or County
<br /> agencies, private conservation trusts or other entities or persons in connection with the
<br /> purchase of such lard and its preservation for conservation and passive recreation
<br /> purposes; to appropriate back to the Conservation Commission Acquisition of Lards and
<br /> Maintenance Account any funds reimbursed from the aforesaid soul,ces in connection
<br /> with this acquisition; and finally,y, to see if the Town w-111 authorize the Conservation
<br /> Commission and the Board of Selectmen to eater into agreements and execute any and all
<br /> instruments as may be necessary on behalt` of the ,Town to effectuate said acquisition,
<br /> safe, transfer or preservation,-, or take any other action relat-in thereto.

<br /> Explanation: This article would authorize the Board of Selectmen to purchase, on
<br /> behalf of the Conservation Commission, 16 parcels amounting to 38 acres located
<br /> between Algonquin Avenue, old Barnstable load and Nathan Ellis Highway, which i
<br /> adjacent to existing town held land & a crucial wildlife corridor. The purchase would be
<br /> paid for with funds from the Conservation Commission-s Commission-sAcquisition of Lands and
<br /> Maintenance Account with potential re-Imbursement from the Massachusetts Water �
<br /> Conservation grants. ..
