Conservation Commission March 1 , 1993 'age 1 . Mir.. man stated it would help for the Commission to advise the Selectmen and agree that the conservation restriction is appropriate. It des sense to be held ,jointly by the Town and Testees of Reservations. The town should have enforcement authority... The trustees have a very keen interest in the Mahpee River, He suggested that agreement should be reached and a memorandum of understanding issued. The restriction wraps around the outside of the develop- ment. Everything within 20 feet of the roadway and buildings is encompassed. I is the only building completed at this time. The Trustees meas are along the giver. He would suggest the Trustees accept responsibility for that portion nearest the river and the town have the render of responsibility. Ms Lana k asked how they oversee their interests Mr. Wyman stated they fly over it once a year or so. Beyond that they rely on friends and staff, or neighbors, to keep them informed. Ms Lannik asked if it is planned to develop the old bogs and was told they do not plan to do so. Mr. Wyman stated terms of the restriction allow for the ability to do trl=ng and pruning in the woods. The restriction wi .l give the Bui .d .n inspector an overview. Once in place, at the Dual meeting of the condo association, they can be made aware of this. OIE Motion rade and .seconded to endorse the Comnussion's responsibility and sena a letter to the Selectmen. It was agreed, once effective, it makes sense to sign a M.emorandunn of Under- standing. A possible land donation to the Town of Mashpee was discussed; this is still in the works and nothing finalized. SMMISH OMMSSIOT: A request has been received for a joint meeting. 1t was agreed to begin the next scheduled meeting one-half hour early and schedule a meeting with thea at that time. The Chairman will arrange this meeting, BMS: 1t was agreed the meeting on March 21 will be rescheduled. It was noted the Selectmen followed the recomendation.s of the Commission on the cranberry lease, Dandy Cranberry Trust received the lease. FR&NM: - Auer discussion it was agreed to deny the sod portion of the filing. Motion rade and seconded to deny that portion of the Domenic Frnchi filing requesting the placement of sod. ENFORCEMENT: -Vegetation cut down on the coastal. bank - Enforcement order ratified.. Enforcement order ratified - Structure to be removed in one month of legal action Will be taken. - Cari l A letter was seat - An enforcement order to be issued in two weeks. Jacobson: Severe damage to the wall; will not file and is clang maintenance in perpetuity. The Order was never recorded or Certificate ofComp- liance issued. it does state maintenance, but n in perpetuity. A letter was sent that repairs cannot be dome without an engineered Plan and Notice of Intent. He is being very cooperative.
