Dom: Letter received from Nichael Grot ,ke re dock not in compliance. It is new owner and the dock was not built according to plan. There was a superseding Order and no Certificate of Compliance given. The order of Condi.t ions has ex- pired so an amended order cannot be considered; _a Notice of Intent must be filed and is coning in, Mr. Sherman asked the Commission to not consider a formal enforcement order. The Commission agreed. , Letter received from Sue Ann Richardson that waterways had received from the Harbormasters Association. They do not want the responsibility of floats attached to docks. Letter from I opelman & Paige concerning the same issue was distributed for review. VOM: Motion made and seconded to empower the Agent to work. with Perry Ellisfor language re bottorn anchored floats needing Conservation approval also. Request from Mary Leblanc re projects at Popponesset Bluff; they w .sh to make modifications to the plan which the agent felt were desirable. He asked if the commission warted a formal amended order? Ms Lannik felt they should go through the process as it is more than one change. i The Commi s s ion concurred. VM* Lotion made and seconded that an Amended order hearing will be required. CGA TREATEDRq: A memo from Rick York was distributed. Mrs. F udala stated she would go along with the recommendations of the Shellfish Warden. Mr. Sherman suggested, if when inspecting for a Certificate of Compliance it is • deemed necessary, they Will be requireds to replace the piles. TMs was discussed earlier during hearing. VOTE: Motion rade and seconded to adopt the recommendation of Rick York on dock construction materials and CCA treated lumber. It will be conditioned that upon the Certificate of Compliance inspection, if pilins are un- satisfactory, they may have to remove the piles. John Fitzsimmons abstained. �vIDT: Richard Rhodes advised that he would do anything to see that what we have left is not destroyed. He would like to do something beneficial to the lana where e lives. He lures on I ashpee-Wakeby lake. The Agent suggested sending a letter to the Selectmen recommending ivx. Rhodes, Motion made and seconded to send a letter to the Selectmen recommending Richard Rhodes as an associate member to the Cor� .ssion Unanimous Note.
