Conservation Commission <br /> w <br /> January 80, 1992 <br /> Page 6. <br /> Mr* Sherm an stated it is not BVW technically; under the Wetlands Act it is Isolated <br /> Land Subject to Flooding, under the bylaw it is fresh water wetland. Also under the <br /> bylaw it is an Isolated wetland. <br /> Mr. Grotzke stated it is a heavily eroded kettle hole. <br /> Mrs. Simmons advised permission had been sought from Mr. Burden to search for a <br /> venal pool which was never received. she further stated the hydrology is needed <br /> to define the we tl.and. <br /> Mr. Sherman asked if there was any historical record? Mr.-.Grotzke stated there was <br /> nothing recorded.. Mr. Sherman stated under the reqs the border would have to be defined <br /> by the vegetation line or talcs, whichever would result in the highest line. <br /> Mrs. Simons stated the Commission would want to wait to see what is identifiable in the <br /> pool* <br /> Mr. Grotzke advised a driveway coming off Daniel's Island Road will serve the three <br /> houses. Mrs. Simmons stated more information is needed on that also. <br /> Mr. Besrosiers questioned the amount of fill to be used. They are going from elevation <br /> 28 to 28 and there will, be a slope. <br /> Mr, Grotzke stated this is approved by the Planning Board. Mrs. Simons asked if they <br /> had seen these changes? She was told it never made it through land court; this is the <br /> way it was originally approved by Planning Board. <br /> Mrs. =' ons stated if the road is upgraded, there could be drainage problems. <br /> Mfr. Sherman suggested the hearing be continued. He listed the items needed: top of <br /> slope; calcs on the 100 year storm; vernal pool issue; and information on where the <br /> slope ceases t . be 1 - 4. Also needed is drainage information on the road and driveway. <br /> VOTE: Motion made and seconded to continue to March 26, 1992 at 8:001, 8:15 and. 8:30 <br /> p.r . <br /> CONTINUED TO MARCH 26, 1992 - 8:002 8:15, 8:309 <br /> ARICOL : Request received from *Jeremy Carter today concerning the revetment. <br /> Backfilling will be necessary to replace materials from the two storms. <br /> Motion made and scheduled to dear the request for an Amended order as <br /> soon as possible after the paper work is received. <br /> =30 SOUTHPORT., Request for Amended order of Conditions under SE 3=708. Ron Bonvie <br /> advised William Henchy, the attorney handling this, contacted his attorney and will <br /> receive a deed. He was concerned that if the property was sold, the parcel would not <br /> be conveyed to the town, Mr. Bonvie stated he is trying to satisfy Mr. Henchy and <br /> is willing to put whatever he needs on record at the registry of deeds. <br /> Mr Sherman sugges ted Mr. He chy be asked to fax a copy .of the. deed to him <br /> Mr. Bonvie stated he does not need the-parcel as a business plan and it is not <br /> included• He would have given it to the town two years ago if it were proper, He <br /> will give the town a document that will protect their interests, as well as he can. <br />
