Ed Pesce presenting. The footprint will be en- <br /> larged with an addition on the rear of the property. It is within the 100 year flood <br /> plain and is 600 feet from the water. <br /> Mr. Homeyer stated it is flood plain but not a velocity zone. <br /> Mr. Tesce advised it started out to be a septic repair then the addition was added. <br /> 1t is seasonal use, for a secondary home. <br /> Mr. Sherman advised the only performance standards are to the building code. <br /> Nis kik asked what kind of footings will be under the deck? Mr. Pesce advised they <br /> are already there, four foot footings. It is only crawl space, no foundation. <br /> Public comments were requested; there were none. <br /> Vim: Motion made and seconded to close the hearing. Unanimous vote. <br /> HFARnG CLOSED <br /> §§§§§§§§ <br /> McKay: He was allowed to do an RDA to raise a dock for Chapter 91 ; it is done <br /> and it is all right. <br /> Conservation Corps: Memo received from Renee Fudala of upcoming events. <br /> 1a.Lijarviy: Required revegetatio plan received. They plan to put in 50/50 <br /> bayberry and rosy rugosa. <br /> a l ag Dock: Mr. Sherman advised there was t be meeting w1th therm before <br /> a decision is made. He asked if the Cormmssion wished for him to meet with them? <br /> Ids kik stated the order has been issued as is. They have had their time to speak; <br /> if for the purpose of negotiation, that would not be useful. she would not like to <br /> see the Agent arguing over something that has already been decided. <br /> Motion made and seconded to rescind the requirement that the Agent meet with <br /> the Baybury village Association prior to issuance of the order of Conditions <br /> and that they just be seat out. Unanimous Note. <br /> Memo received from the Harbormaster that an application was given to Mr. Levine. <br /> He advised him that the Comnussion feels he must flole with Conservation also. <br /> There was an exchange between the Agent and fir. Homeyer; they were in disagreement <br /> on the application of this law. <br /> Ms Lannik stated an answer cannot be given until Town Counsel reviews this. Infonn- <br /> ation has been contradictory that was received from DEP. <br /> Mr. Homeyer suggested a letter be written to the Executive secretary and Selectmen <br /> that the Commission is being held tip by Town Counsel.'s inaction. <br /> VOTE: Motion mane and seconded that the Agent write a letter to the Executive Sec- <br /> retary and Selectmen to adv-.se them of this situation. <br />
