' f <br /> f <br /> J <br /> *r <br /> y MASHPEE CONSERVATION CONUSSION <br /> Minutes of Mrch 12, 1992 <br /> Commissioners Present: Harry Desrosiers, Gertrude Simmons, susana Lid , Frank <br /> omeer, Renee Fudala, Kathleen Terrio, John Fitzsimmons. <br /> The meeting was called to order at 7:00 p.m. <br /> 6:45 ROBERT W. & NEWRED WFJNSTEIN for an After-The-Fact filing for an existing <br /> dock, retaining walls, walkway, stone landscaping and the installation of picket <br /> fencing and drywell at 79 sunset Circle, Assessor's Map 64, Parcel 7. Dave <br /> Sanicki of Cape & Islands Engineering presented abutter notification receipts, <br /> Mr. Sanicki advised items filed for were done without approval.. The plans provided <br /> show what is existing on the ground. A new drwell is proposed. <br /> Mr. Sherman stated nothing, except the drainage pipe, was of any obvious concern. <br /> The dock is being filed for also. Fees are appropriate. Pipes holding the dock <br /> are adjustable. <br /> Mr, Fitzsimmons asked whir this is after-the-fact? <br /> Mr. Sanicki stated a Certificate of Compliance was requested in order to transfer <br /> ownership of the property. At the on-site the items now iled for were not shown <br /> on the previous plan. Asked how long these items have been in, he stated five gears. <br /> Concern was expressed that the new owners be aware of the background and that this <br /> not happen again. <br /> A letter was reviewed that was provided by counsel of the new owner. Mr. Sherman <br /> stated it can be conditioned that any future alterations have to come before the <br /> o�.ssion. He was satisfied with the as built. Also, any future rebuilding of <br /> the dock should go through a filing. <br /> Mr. Fitzsimmons is concerned with f t r--The--Fac t fil in s. He wanted to make his <br /> point clear. <br /> Mr. Sherman advised DEP would not find In the Commission's favor if it meets the <br /> performance standards. <br /> Mr. Sanicki advised the runoff pipe will be disconnected; it goes through the <br /> bulkhead. <br /> Public comments were requested; there were none. <br /> VM: Motion made and seconded to close the hearing. Fri Homeyer abstained. <br /> 7:00 GAS . ROBINSON) 11 Bowsprit Point, continued from May 2, 1991. Mike McGrath <br /> advised they will be requesting another continuance but wanted to explain. The <br /> have applied to the Board of Health at a series of hearings. They applied to put <br /> the septic in the street but did not get a positive action from the Planning Board. <br /> They have engaged an Environmental.Consultant to determine the wetland. <br /> They will now. appy for a different type of septic system; that will take several <br /> months. He displ.a red a drawing of his Ruck-system and explained, the workings. <br /> A. four month continuance was requested.
