Conservation Commission <br /> r <br /> June 18, 1992 <br /> Page 8. <br /> Mr. Sherman stated the deck is the only issue, structurally, It had to be done as <br /> an amended order. 1t does not go any closer but it is different than what was orig- <br /> inally presented. The owners Ed not -know the deck was built without a permit and <br /> it has been taken out. Nothing has changed square footage-wise. <br /> Mr. Tarabelli showed pictures of the abutting properties and their decks. <br /> Mr. Sherman stated it is very flat until you get to the dune; there are no threats <br /> i <br /> of erosion there. <br /> Public comments were requested: <br /> i <br /> WILLIAM FERGUSON.- e pointed to the deck constructed and advised he sent a letter on <br /> June 9 requesting that a tree that was removed at the corner of the easement be replaced. <br /> It was ahealthy tree that was removed and . hould be replaced; it does, add decor to the <br /> property. He would respectfully request that the Beach Plum tree be replaced. <br /> Ir. Sherman stated they cannot be compelled to do this. <br /> Mr. Tarabelli advised the projection on the rear of the structure requiring a <br /> foundation and excavation got into the roots of the tree. <br /> Mrs. Solomon, who was present for the hearing, stated she had absolutely no <br /> objections to some replacement of the tree. <br /> Mr. Sherman suggested conditioning something not that sizeable. <br /> Mr. Tarabelli agreed to submit something through their landscape architect. <br /> Mr. Ferguson asked if the grass areas will be replanted when project is completed. <br /> Mrs. Solomon stated everything there will go back. <br /> Vim: Motion rade and seconded to amend the Order of Conditions as requested. <br /> AS REq <br /> 9:15 ROBERT J. DEPIEMI to permit and maintain the existing 22 foot extension of <br /> an eating permitted pier system at 5 Keel Way. Susan .Amus presenti-ng.. <br /> Mr. Sherman advised a Certificate of Compliance was requested and the structure <br /> was 22 feet longer than permitted, Shellfish has no problem with the addition. <br /> He did not feel there were any adverse impacts and it could be approved with the <br /> added condition that they cannot attach the boat lift without a filing. It can <br /> be closed pending whether this should go back before the Board of Appeals. It <br /> was originally built in 1984 and there is no record of Zoning Board of Appeals. <br /> It was noted there are now two floats, <br /> Ms Asmus advised `the boat using the structure is a 21 foot 10 with a draft of <br /> two feet down, one foot u . <br /> Mr. Sherman stated there has been prop dredging for years. <br /> Ms Lannik stated if out back, it will be in shallow water. <br /> MS mus advised the applicant has agreed to reduce the float to 41 x ' 'an <br /> ' x 201 on the outside, giving 200 s.f. total..
