Conservation Commission
July 1 , 1992
Public Hearing - Page 5.
clear large areas. It is important to maintain a natural strip of vegetation between
people and the water. This is to have something substantive. State law allows the
Commission to make assessments.
Mr. Sherman advised the Commission wi 11 take further written comments if the public
wishes to provide thea.
Alteration of a total. of 5000 or-more square feet of any naturaUy vegetated area in
LSCSF on a lot, with the exception of the construction of a single family home shall be
presumed to have unacceptable significant or cumulative effects. upon the protectlon o
wildlife habitat. The burden of proof is on the applicant to prove it is not.
For single family domes, the Commission would ask in some oases that with home construction,
or additions, if it is feasible that vegetation be replaced in another area on the lot to
compensate. The -Commission is asking to maintain, if feasible, some natural buffer strip
of vegetation paralleling the shoreline.
Unless no feasible alternative exists, 50% of the indigenous vegetation on the lot shall
e left in its natural state. A path to the beach would not be precluded. vista pruning
should be done under the guidance of an arborist.
It is asking that all structures be s cured. Prevention of stem damage is mandated; the
Commission is trying to be more specific.
Under 3b, alterations, such as impervious driveways could evert storm surges. The
Commission wants to look to see if storm damage will be rade worse.
Mr. Sherman concluded his sunn.ary.
oments by Monomoscoy Improvement Trust
Jim Hanks stated the wording of this implied rede ` nJtion of the coastal storm flowage,
Mr.. Sherman advised there is no change in the ,jurisdiction. It Is 11 feet in most
places; it is the statistical 100 year storm.
Conery asked if only the portion in the flood zone or the whole lot.
Mr. Sherman stated 100 feet from the defined boundary is where the 100 year storm stops.
Jim Hanks advised concern is that since all of Monomosc y is below 11 feet, if anyone
wants to cut a twig, they would have to have Conservation approval.
Mr. Sherman stated this is not true. Cutting for vista ping is allowed; the Commission
wants to know what is being done.
Richard Halpern stated the whole island of Monom se y will be subject to this. Anybody
on Monomoscoy doing any alteration t ,their house would have to do this.
Mr. Sherman stated if the area is already disturbed and is 300 feet from the water, it is
not an issue. The part under 2A and 2B only refers to naturally vegetated areas.
Richard Halpern stated under C 1A, if anyone has a pent to alter, they will have to
provide this plan.
. The Commission's concern is wild.li e; they should include human beings as well.
