Assessors advise the dock has been assessed since 1981. <br /> The six mooring piles are shown in red; there is 535 S.E. of coastal. structure. <br /> Maintenance is requested in the order of conditions. They will then file for <br /> Chapter 91 and ACCE. Resources are: Land Subject to Coastal Stom Flowage, Salt <br /> Marsh, Land under the Conan; and the flood zone endicated in brown on plan, 'fie <br /> area has not been surveyed but they have made the assumption it is a shellfish <br /> habitat. The edge of the salt marsh upland has been demarcated by 12 numbered <br /> stakes. The salt marsh is not only protected under 131.40 but now a restricted <br /> wetland under Chapter 130, sect. 105 also. It is compatible with allowed use <br /> under 131.40 and also the conservancy program. It is not required to send it to <br /> them but he agreed to do so. <br /> Two boats use the facility, one 24 foot inboard with 12-16 inch draft and one <br /> 20 foot outboard with 14-16 inch draft. The ramp does not bottom out at any time <br /> He suggested lengthening the structure to lessen the chance of it bottoming out. <br /> Mr. Coffey stated depths are only indicated at the pilings; Mr. Gray agreed to <br /> provide more. <br /> [finder Chapter 91 they are constrained to show docks as they are, not necessarily <br /> as you would want them to be. He would be willing to work with the Cormaission <br /> s long as it does not ,jeopardize his Chapter 91 permit. To put on steps would <br /> negate Chapter -91 standing. However, the Commission is able to interact during <br /> the comment period and would be entitled to make any design change to utter the <br /> structure. <br /> Mr. Somerville advised he saw it this morning at a negative low tide. if con- <br /> s Jdering <br /> n- <br /> sidering a new structure, he would make it 20-25 feet longer. Boats are close <br /> to the bottom and a depression has been ma e. He suggested turning the float <br /> 9 ' and putting a boat on either side, which might preclude the use of the side <br /> slip. It is a difficult area to classify as shellfish habitat, it may be good <br /> for 1 - 12 feet, there are isolated batches. There would be no access at low <br /> tide. <br /> To the question of soundings, Mr. Gray will check with the engineer. Ms Behrman <br /> asked if,6" depth, 2.5, is down to hard bottom or mud surface? <br /> Mr. Coffey asked how seeking Chapter 91 relates to the matter before the Commission <br /> and was told if granted an Order of Conditions they would then send Chapter 91 an <br /> amended pian of record. The applicant agrees to these changes but does not <br /> want to jeopardize permitting, <br /> The Agent will contact Chapter 91 comment. Mr. Gray suggested a written <br /> condition would be adm i s sable. <br /> Ms Larmik stated that abrogates the town's authority. ir3 a very unusual way. <br /> Mr. Hmeyer pointed out it was not necessary for these people to come before the <br /> Coliniassion. He suggested a letter be written to the Secretary of Environmental. <br /> Affairs to request a definitive set of procedures to fallow. <br /> Issues.- Soundings requested - clarification whether soft mud or down to bottom. <br /> It is not suggested the plan be changed to reflect the addition of 25 ft. <br />
