uonservauion uommission
July 25, 1991
Page 3.
Ms Behrman stated that creates a problem for shellfishermen.
Peggy Fantozzi advised, because of pre-existing use, Chapter 91 does allow steps
up and over it.
Mr. Wilson stated that would be no problem to his client, if required. Two or
three steps would be necessary.
The Commission was advised the float is stored on the existing structure in the
winter. Mr. Wilson stated if this was conditioned his client would comply.
Mr. Coffey asked the elevation of the docks and was tale elevation is 4 feet from
Mean Low Water. He further asked if there was a railing and if the percent of change
would affect amnesty? Mr. Wilson stated no to both.
The Shellfish Warden advised there are patches of soft shell clam close to the bank.
He felt that steps would be helpful.
Mr. - Sherman stated the exact location of the steps should. e marked on the dock to
be sure they do not lead to a salt marsh area. He agreed to meet at the site with
Mr. Wilson,
VOTE: Motion rade and seconded to close pending an on-site With the Agent and
receipt of an appropriately marked-up plan with the step location.
CLOSED PENDMON-sT AND REVISED PLAN.
8:00 Ro T K. KRAFT for the permitting of an existing pier, ramp and floats at
24 Popponesset Island Road. Stege Wilson advised new plans were submitted, the
originals were incorrect. This is the same scenario as Hassey. The structure
has a history of previous waterways licensies. dere was a change in float config-
uration in 1980-1.981 and they are going forward for an Order of ConditiLons, and
Chapter 91 as it sits. The main fixed portion has been there since the mid-1950's.
The length of pier is 1101 , cramp 16' , floats 2 - 20 x 6, l - 24 x 6. Old licensed
plans show an 8 x 10 float. In 1966 the 8 x 10 stayed and a 6 x 16 added. Board
of Appeals approval received for thepier being over 70' and 3 floats. The boat
is tied up on the ,inside now. Boats are limited to those with 2-112 ft. draft.
Ms Behrman questioned the 2,1 foot depth at the float.
The Shellfish Warden advised there is a basin off to one side. This area was
productive quahog bed, commercially viable, and it was stripped. It has been
coming back with the help of seed. If this was a new application he would be
against i t, At this length there is some scouring in the area of the floats.
He felt this is more acceptable than 70 feet. There is a. 25 foot Whaler and
small ski boats.
Mrs. Simmons questioned the necessity of three floats and suggested el- l mating
one.
Paul Somerville suggested the Commission prevent anything from tying up on the
edge of the pier. A project applied for to the south, Jaye Sons Trust, was denied
and has since lapsed. He would not want vessels tied up to the side.
Mrs. Simmons asked if this can be enforced with the Harbormaster?
Mr. Wilson stated the Order of Conditions would be picked up with any change o
ownership.
