Conservation Commission
August 23, 1990
Page 15.
Mr. Chairman, as agent I would like to advise you that as far as I am
concerned, the Glass's have provided all the information at this point that we
need. 1 do not see any reason for any more testimony for us to make a determination.
It did prolong and protract it, it was no one's fault, you were out of the country
for a while and quite frankly this is a very busy office, 1 can't follow up on things
as 1'd like,
MR, GLASS: You have been very cooperative, Mr. Shernan. Nothing I said reflects on
the professionalism of . Sherman. I am saying it must be something connected with
the way I t m treated in this town if he can look at my violation. . (SBERMAN: Not to
my knowledge, I try to treat every violation the same. At any rate, you have supplied,
I believe, everything we need and the wildlife habitat assessment is satisfactory and
I think we have sufficient information.
OFFEY: I would just like to reiterate the range of options available to the Con -
ission as stated at the August 9 hearing: to permit it as pre-existing; to condition
it for further nourishment; prohibit further nourishment and as an after-the fact
could order it's removal.. In the expert's report, it was pre-existing, has not
changed .substantially, but eight toms was added without permission. The sand in
place has not caused a significant problem. Getting the sand to the site was an
issue.
IRS. GLS S: I would just like to add that 1 did not know of this true incident,
just to put that on record.
COFFEY: Perhaps it is not germain, but 1 would like to offer that earlier in the
evening our goals and priorities for the year were discussed. one of our top
priorities for the next twelve month.period, and we hope we can be successful on
It. is public education and outreach. Given your expressed environmental. concerns,
1 would hope you would avail yourself of every educational opportunity and I would
like to think the commission could offersubstanti 1. ones in the coming months and
years. For instance, fir. Dorton has requested copies of the reqs and bylaws, as
landscaper, he will have 'a better sense of what is perm sable, what's not, or how
to go about getting permission for what kind of cases.
I'm sorry you felt singled out in this process. Perhaps a better knowledge of the
ashpee Wetlands Protection bylaw and the State Wetlands Act would help you and help
further your own interest in the environment. Perhaps, in addressing other violations
that you may know of around town that may be of interest to us also. . I would hope
that something positive would come out of this, whatever the final determination of
the commission,
R. GLASS: When will we kn w of the final determination?
COFF Y: I would entertain a motion at this time, if the commission is comfortable
with the facts or whether they merit further consideration and debate. I believe
we have all the information necessary before us. 1 ann inclined to close the hearing;
I do 't believe any further hearings or information is necessary. Is that the con-
sensus of the commission,
SIMMONS: I move we close.
Motion made and seconded to close the hearing. Unanimous vote,
MRS. GLASS: I would like to leave it open to us if we want to come back.
MR, GLASS. We will come back with the other violations, of course. I would like
to give the secretary a copy of my remarks to the comnuion.
