lA H E E CONSERVATION COMMISSION F
MEETING OF JANUARY 25, 1990
Commissioners Present: Gertrude Simmons, V. Louise Behrman, Richard Halpern,
Harry Desrosiers, Patrick Coffey, Joseph Burns.
Robert Sherman, conservation Agent, Duncan York and Edwin Beeby, candidates
for- membership, were present also.
The meeting was called to order at 7; 10 p.m.
The chairman stated she would like to interview any applicants present and send
letters to the others setting an interview date. A letter to be sent to Marcia
Johnson also.
7:30 Michael & Beth Moskowitz, to permit an existing dock, ramp, floats and
piles at 146 Popponesset Island Road. Dave sanicki of Cape & Islands surveying
presented abutter receipts and additional copies of plans. The prior bearing
dealt with the relocation of the connecting stairway shown on the plan with a
dotted line. The plan shows two floats. They have an Order of Conditions to
extend the dock to the upland side and relocation of the steps, dotted on the
plan. As the extension was upland, above the high water mark, it did not
concern the Array corps of Engineers or the state. There was considerable
discussion at that time concerning the floats and two pilings in plane.
They have returned for appropriate permits for the dock itself. There is
documentation that the structure is grandfathered by the ACOE. They went
before the Board of Appeals for ars extension of a pre-existing use to get a
building permit. There was discussion whether it is existing or altered. His
presentation was, this is existing, this is ghat they would like to license.
The neighbor contends the floats acre larger than before. From a survey point
of view, they located and measured.
Last evening, at the Board of Appeals, Paul Somerville indicated he was not in
favor of licensing the structure as shown on this plan. Under consideration i
the new chapter 91 required. under the state, that requirement is in the mail .
Question was , is it a new structure or existing? As shown on the plan, the
upland float does bottom out and there is a viable shellfish area. It i
also shallow water. Mr. Somerville did not want to see boats in the shallow
water.
A revised plan as of January 25 was reviewed. her. omerville's comments to
remove the inland float were accepted. The revision only shows the outer
float, in the enact same position. They have extended the fixed structure
and relocated the ramp. The owner has two boats, one 27 ft. ; a 20 ft. float
for a 27 ft. boat. They will leave the existing pilings for the anchoring of
the longer boat and -they will add 4 new 2" pilings for the fixed structure.
They are replacing a 20 ft. float structure with a 4 f t. fixed structure in
the low area.
Nor. Coffey asked what the depth of the water would be at the end of the float
and was told 2- 2 to 3 feet of water at the low end and the boat will not
bottom out. (They propose one float 61 X 20' ). They will go back to the
ACOE for an appropriate permit for what is proposed.
Mean Low darter is shown on both sides of the channel with a maximum of 10 feet
of water.
