Conservation commission <br /> Ar i l 26, 1990 <br /> Page 4. <br /> LETTER To THE BOARD OF ASSESSORS: The agent is being requested to view properties <br /> and declare their unbui ldable under the Wetlands act. <br /> It was agreed this encroaches on the agent's time and puts the agent in the position <br /> of making n decisions for the board. <br /> VOTE: Motion made and seconded to direct the agent not to to respond to requests <br /> from private individuals. A list of engineers will be provided to the <br /> Assessor;s office. Unanimous Vote. <br /> NO COALITION: A letter received looking for resolution. They are seeking coal <br /> power moratorium. <br /> OTE: Motion rade and seconded not to endorse. Unanimous vote. <br /> ROBERT MAXIM: No record an amended order was filed for deck extension, To be <br /> required for a certificate of Compliance, <br /> WILD LIFE HABITAT PROTECTION: A handout with checklist was distributed. <br /> NEW SEABURY GOLF COURSE POND -- Filing Fees: Question was raised whether two fees are <br /> involved. D.E.P. felt there were two issues, point source discharge and also raising <br /> and lowering of water levels. The agent to inform New Sea burry. <br /> LE I HE: It was ordered that the float, which is still i n, be taken out immediately. <br /> Atty. ills asked that this be handled inforri ily and was 1C.o o lntact the commission <br /> prior to this meeting to notify that it would be out within five days. No word has <br /> been received and Mr. Sherman recommended a NCD fine be issued tomorrow. <br /> Nor. Halpern stated he would rather talk to him some more. <br /> VOTE: Motion rade and seconded to check the paper trail . If tight, an NCD fine <br /> to be issued; if not, an enforcement order to be issued with written response <br /> within orae week. Removal within two weeks. <br /> In Favor: Duncan York, Patrick Coffey, Harry Desrosiers, V. Louise Behrman <br /> Abstained: Richard Halpern. <br /> MINUTES: Mote: Lotion made and - seconded to accept the minutes of April 5., 19903, <br /> as written. <br /> BRADSHA : Denial signed. <br /> COVI H: order of conditions issued. <br /> NEW SEABURY - Rook Landing Road: Order of conditions to await minutes, <br /> D.E.P. Question & Answer Session: Concerning whether to require a Notice of Intent <br /> on an Enforcment Order, there are certain advantages not to. A revegetat i on plan <br /> can be ordered and cannot be appealed. The only appeal process is whether the <br /> commission acted properly. <br /> UFFLEHEAD BAY: Duncan York and Bob Sherman went to Buff l ehe d and identified sore <br /> vernal pools, Also located were some spotted turtles, a species of special concern. <br /> Information has been forwarded to Natural Heritage.
