r <br /> ASHPEE CONSERVATION COMMISSION <br /> Meeting of Ma y _ . 1 , 1990 <br /> Commissioner present. Gertrude Simmons, Joseph Burns, Duncan York, Harry Desrosiers ,, <br /> Richard Halpern. <br /> The meeting was called to order at 7:00 p,m, <br /> ANDREW KARIOTIS--SE 43-135: Susan St, Pierre of Fort Point Associates came before <br /> the Commission to request permission for her. Kariotis to install his seasonal pier <br /> for this boating season. Last year, (Actually 1987 he received approval for a <br /> permanent pier but has been unsuccessful in obtaining permit from Waterways ; h <br /> does have all permits for a seasonal pier. Repair and replacement of the PITC sleeves <br /> in the bottom of. Jehu Pond will be required. <br /> It is their feeling, because the pier is seasonal , the repair and maintenance of <br /> those PICC sleeves would be allowed under the existing order of Conditions issued <br /> September 10, 1980. They wanted to be sure that was the Commission's interpretation <br /> and that an amendment to the order of Conditions might be appropriate. <br /> Mr, Sherman stated there was some misunderstanding about the PVC sleeves actually <br /> being down into the land under water and enclosing the piles. The original pian <br /> of record does not show those sleeves, <br /> Ms St.Pierre stated the plans given to herby Mr. Kariotis have a cross section of <br /> the piles. <br /> Mrs, Simmons reiterated that was not the plan on record. <br /> Nis St.Pierre stated the order of Conditions did authoriz a the installation of the <br /> PITC sleeves in 1980. Mr. Sherman asked where it made reference to the sleeves? <br /> She stated it's not there, but it was in the Notice of Intent, logically speaking, <br /> there is no way ,your can have a seasonal pier, unless you have a PVC sleeve or <br /> something to hold the pile i n there. They came before the Commission at that time <br /> o ask which alternate location of the pier the Commission would like, that's what <br /> this plan is, from what she stated she was able to read from his records, and the <br /> Commission chose one location for this pier. There are 11 PVC sleeves. His intent <br /> was,, and still is, to eliminate the PITC sleeves with a permanent structure. <br /> The recent filing for the permanent pier was reviewed for information. FIs St.Pier r <br /> asked to look at the original Notice of Intent. <br /> When asked how the sleeves would be put into the ground, she responded they will <br /> be ,Jetted in. <br /> Mr. Sherman advised , with the number of ice damaged docks known to came up in the <br /> Spring, clarification was sought from D.E.P. , Lakeville, which was received in <br /> writing. It is quite clear that unless them is an order of conditions which <br /> states maintenance and a Certificate of Compliance that states maintenance, the <br /> driving of any new piles requires a new Notice of Intent. <br /> Ms St.Pierre stated piles are different than sleeves. <br /> Mr. Sherman stated they are different, but the affects are the same. I ,you have <br /> land under the water and you drive a new PICC sleeve, it has the same affect as <br /> driving a pile. <br /> Ms St.Pierre stated, given the fact It is a seasonal pier vs a permanent pier, <br /> it is presumed that every year ,you're going to have to go in there and jet out <br />
