Conservation Commission
November 29, 1990
Page 6
Mr. Desrosiers pointed out coverage has increased 130%. The 5 foot is allowable
he felt but the wings must be removed.
Mr. Homeyer stated the regulations are that it be 4 foot wide; the commission should
take a stand and insist this come down.
Mr. Coffey stated the extra length is within allowable parameters but the total
extra built size is striking. With the shellfish warden's testimony, the wings
should be removed and the structure brought back into less total footage and the
removal of the extra 10 - 12" overhang.
Mr. Sanicki asked if it is being requested to cut the wings off and the extra
width on the entirety of the structure?
Ms Behrman pointed out there is a 50% increase in the width alone. With 6 foot
width the shading has an effect on the water as well as the marsh.
Mr. Sherman stated tarps would have to be suspended below the structure so that no
wood chips end up in the water or on the marsh.
Mr. Homeyer questioned allowing the extra 5 feet to remain, plus the ramp.
Mr. Coffey stated the commission should have a revised plan showing the structure as
it will be modified. Ms Behrman stated a dated as-built can be required at the comp-
letion.
VOTE: Motion made and seconded to condition the pier to the original width, allow
the additional length and ramp, and to require removal of the wings.
HEARING CLOSED.
7:45 W. BRADFORD WUATT•w.v, Lot 11 Tide Run, continued hearing.
HEARING CONTINUED TO DECEMBER 27, 1990 - 7:45 p.m. at the request of applicant.
SARAKUMMIT CORP. : John Falacci came before the board and advised they are finishing
the clean up of debris, loaming and seeding, work on the catch basins, and final
pavement. It is their responsibility to meet requirements of the Planning Board
who prompted the completion of this work. It was brought to the attention of the
Conservation Agent. There is a difference of opinion whether they should have
notified the commission because shoulders of the road are within 100 feet of the
wetland. They did not file and they do not fall under the regulations. They are
not recreating but stabilizing the shoulders.
Ms Behrman stated they are depositing fill within the resource area.
Mr. Falacci stated the majority of the work is done. It is their opinion they were
just stabilizing. If a difference of opinion, Sarakunmiit Corp. would request mercy
to complete the work per planning board rules and regulations.
Mr. Sherman advised he feels it is in the town's best interest to go ahead and there
is no impact. He discussed this with Tony Ferragamo and Tom Fudala. It should have
been filed for. He did not feel it was appropriate for him to tell them they did not
have to file. Hydroseeding remains to be done. The Planning board is holding a sum
of money until completion and will hold this until the commission is satisfied. It
is the board's decision whether a filing is necessary to complete the work.
A plan was reviewed. Mr. Falacci pointed out the areas that have been paved. They
are removing stumps that were dumped there, as requested to do.
