ti 2-
Mr. Reardon i I have reviewed this matter and it seems that the real issue here is _
not so much the issuance of the ord6r of condition and the fact that a year has gone
by but it is a fact that there has been an alleged violation of the Wetlands Protec.
tion Act which was observed by the chairman of the commission which caused her to
send a cease and desist order. That's something I believe that can be rectified, If
I am not mistaken, I believe you told me that fir. Ferguson related to you that he is
going to remove the sand and restore the area. Am I correct, Mr. Ferguson?
Mr. FeMusont That is correct.
Mr. Reardon: Have you taken the steps to do that or do you intend to?
Pyr. , i r He will do it as soon as he is allowed to do it. We had the workmen go
back there and secure the building and Mrs. Delory went there with a police officer
and threatened arrest if they did,n*t cease working in that area.
Pauline t I didn't threaten thea.
Mr. M s Mr. Ferguson has indicated to Mrs, Delory at least on one occasion, per-
haps on two occasions, that he will take the letters that have been received and have
the men go back to work.
Mr. Reardon: 1 would presume that the f1rst order of business that the commission
should consider tonight is the request that is before you by gray of a letter from
Mr. Ferguson.
Pauline: I just received his,,yesterday.
Mr. Murp s What, is the date stamp on the letter?
Mr, Reardon: November 16. And this requests that the board extend the present order
of conditions. I have examined the order of conditions and I would think it would be
appropriate for you to address yourself to that issue first If you vote to extend the
order of condition. The second thing you should address yourself to is the suggestion
of Mr. Ferguson that he is going to correct the problem that has been created. And 1
think that-you can discuss with him when-h e-.-ins going to do th is and how- he is going, to
do it. I think that would be appropriate.
Janes: Yes, because 1 think the two are getting confused.
Mr. Reardon t Totally separate.
Pawl in t Dos the board want to make a vote?
Charles: I vote that we consider an extension of the order of conditions which were
dated / ,
Mr. Reardon s Do you want to put a time on ito six months or a year or however long you
want to extend it
iia nei In the review of these conditions, should we add any new conditions at the same
time? For examples the ones we wish to discuss with Mr. Ferguson.
