MASH'MASHPEE CONSERVATION COMMISSION <br /> Meeting of February 20 , 1986 <br /> Board members present: March d Font, Chairman; Pauline DeL ry; <br /> Louise Be hrman; Gertrude S . Farrada . <br /> Board members absent : E. Stuart Peoples ; Elliot Rosenberg; <br /> Dorothy G. Studley. <br /> Others ; present were Mary Brown; Carol Jacobsen; Wil a nt ler o ; <br /> Judy Mills ; Associate members . Gerald Sprout , Associate member, <br /> was not present, <br /> Ms . duPont stated that Mrs . Studley has notified d the Board. of <br /> Selectmen that when he,r term expires June 30 , 1986 , she does not <br /> wish reappointment as a full.-time member, <br /> The Chairman noted for the edification of ALL persons present <br /> and all those persons that they may represent that the hearings <br /> scheduled for this meeting have not been advertised for the legal <br /> number of five days in the newspaper. The hearings have been <br /> i <br /> advertised four days . She further noted that the scheduled hearings <br /> have been posted according to law by the Town Clerk on the bulletin <br /> board of Town 'Hall the rec uir�ed length of time and still further <br /> that all applicants and/or heir agents have been duly notified as <br /> proscribed , <br /> The Chairman stated that in the past when this situation has o c cure d , <br /> the Board of Conservation Commissioners has heard the scheduled <br /> hearings with the approval of each individual applicant and/or their <br /> agent with the provision that orders of condiLtions written for each <br /> project will not be issued for at least ten "'working" days in order <br /> to allow anv abutter or other party with. a valid objection to dome <br /> before the Board and be heard,, <br /> Mrs . DeLory, objecting to ho 1 d ing the hearings without full con- <br /> formance <br /> on- <br /> f rmance with the law regarding the number of days advertised, <br /> stepped down from the Board for these hearings . She called attention <br /> that by this action, here was not a quorum of Board members . <br /> The Chairman noted and it was acknowledged that the Board has at <br /> times in the past held meetings and heard proposals with a three- <br /> member quorum due to the fact that for several months for all <br /> f practical purposes the Board has operated as a five-member Board . <br />
