After discussion, it was unanimously <br /> decided to deny the request for various violations of the order <br /> of Conditions issued. Letter was written and will be sent to <br /> Mr. Haran' guying reasons for denial and demanding compliance . <br /> o k ay Bay Realty Tru SE 3-428 <br /> Letter was written and will be sent to the planning Board asking <br /> them to hold the Performance Bond for Cartal Development ment Corp. <br /> and ookway Bad` Realty Trust until the Commission is satisfied <br /> that work is done according to the order of Conditions . <br /> Robert and Pauline DL (SE 3-3 <br /> The Chairman stated that it has come to the attention of DEE, <br /> herself and unknown persons who have rade complaints that work � <br /> is being performed at property owned by Mr. and Mrs . DeLery at <br /> Bay ,oa.d in violation of the Wetlands Protection Act, Ms . duPont <br /> further stated that an on-site inspection of the property had <br /> been rade today by Elizabeth Koulha.ris of DEQE, Ms . Koulha.ris <br /> telephonically informed Ms . duPont late this afternoon that if <br /> the offending situation was not 'immediately remedied , an Enforce- <br /> ment Order would have to be issued. <br /> Ms . DeLory stated that the situation had been remedied. <br /> Requests for Determination of Applicability mus` e ceforth be <br /> publicly adver ised for public hearing and advertising costs and <br /> filing fees must be duly assessed. <br /> New s eabury Corporation SE 3-316 <br /> The Commission has received a. request for a Certificate of Compliance <br /> for this matter for work that has been done to date , The Chairman <br /> said that it would be advisable to wait until legal opinion was <br /> received . <br />
