Maspee Conservation Commission <br /> Meeting of November 8, 1984 <br /> Page Three <br /> 5 <br /> Ms . Collins stated that the Determination of Applicability in this <br /> matter has not yet been received by the parties and which had been <br /> mailed to the Conservation Commission on October 29 : 1984. This <br /> had been discussed at a meeting of the Board of Conservation Comm- <br /> issioners on October 25, 1984. Mrs . Studley acknowledged receipt of <br /> the Request for Determination. <br /> Ms . Collins went on to say that the Commission has requested certain <br /> information of the Benoits and that the Commission has ordered a verbal <br /> enforcement order even though there have been attempts to supply the <br /> requested information ion specifically at a meeting of the Commissioners <br /> on October 25, 1984 and additionally by letter mailed to the members of <br /> the Commission by Certified Mail Return Receipt Requested. Ms . Collin <br /> stated that these attempts to supply the requested 'information have <br /> been denied . she stated that Mr. Kirrane , Mr. Benoit and her-self were <br /> present tonight at the specific re ques-t of the Commission members t <br /> present themselves and the issue at a scheduled time . Ms . Collins <br /> further stated that the specific scheduled time had been set for tonight <br /> 8 :15 P. M. <br /> Ms . Collins continued, " detailed in all of the information that was <br /> submitted to you, Part of the scope of the project did change in relation <br /> ion <br /> to the addition Which is the only part of the project that falls within <br /> the jurisdiction of the Conservation Commission being located in the <br /> buffer zoneV -That change in the plan was simply a change in the maaterial <br /> of concrete blocks to a poured foundation walk.. The cottage that was <br /> going to be remodeled was disassembled but all of that work falls outside <br /> of the buffer zone and therefore outside of the jurisdiction of the <br /> Conservation Commission." <br /> Ms . Collins staffed that the filing made tonight is to cover that change , <br /> Mr. Benoit spoke briefly emphasizing previously-made statements . <br /> Mr. Kirrane - spoke also Para-phrasing prior statements and said addi - <br /> t i n lly, "The 12' x 12" addition which was the subject matter of the <br /> initial. Notice of Intent is within the Jurisdiction of the Board and <br /> the Board has issued an Order of Conditions . The Order of Conditions <br /> can and will be complied with, Theria was a modification to the plans . <br /> or the oral presentation,not a modification to the plans because 1 <br /> believe the plans which were submitted to the Board did indicate <br /> PbUr6d cement foundation and not a. cement block foundation; however, <br /> it is my understanding, although I was not here at the night of the <br /> hearing, that there was an oral modification of those plans to provide <br /> for a cement block foundation and the jacking up of the original building. <br /> Attorney Kirrane further stated, "as far as the 12# x 121 addition t <br /> that building is concerned, the only change is now there is proposed a. <br /> poured cement foundation rather than, the cement block foundation, we <br />
