Conservation Commission <br /> Meeting ofAugust 2 , ]986 <br /> Page 3, <br /> William Burke - continued <br /> March duPont advised this is not a matter for an Emergency Order of Conditions <br /> as the emergency does not exist and a notice of intent should be filed. <br /> The Mass. Code for an emergency Order of Conditions was read by the Conservation <br /> Officer. <br /> Ms duPont questioned a stairway and concrete pad which were constructed without <br /> an Order of Conditions which Nor. Burke was instructed to remove. [fir. Burke <br /> stated when he bought the house he was told there was ars existing DEQE number <br /> under which he could make repairs. He stated he. has all the paperwork where <br /> permission was granted by the Town of Mashpee and the Conservation Commission <br /> to take the repairs, He stated the wall was built in 1972 prior to DEE per- <br /> mission being required. <br /> Ms dot stated at the time of purchase of the property there was a cloud on <br /> the title because there wasn't the proper DEQE number for the work on this <br /> coastal bank and on the beach and Mr. Burke 's attorney found there was no <br /> existing order of Conditions and it was considered illegal . She further <br /> advised the Building Inspector, who at that time was advisor to the Conser. <br /> vati on Commission.. put a stop work order under the state building code and <br /> work proceeded on the stairs , concrete pad and bulkhead. <br /> Mr. Bur e 's engineer, Urban Cl o ran of Atlantic Design stated that concerning <br /> the nature of an emergency there has been structural movement in the house <br /> and documentation can be presented. He further stated orders were issued to <br /> repair the wall subsequent to the construction which would seem to suggest <br /> that the wall is val i d. <br /> Ms Behman requested copies of any correspondence and records o-f a DEQE number. <br /> John varkonda stated the neighboring lot, #528, is where the problem is coning <br /> from due to the revetment on either side as - the erosion will continue in a fare <br /> shape. The only way to protect the house is to add to the revetment. <br /> . Goran stated Mr, Burke is requesting to construct a stone structure starting <br /> with larger rocks going to smaller rocks and integrated with filter cloth. <br /> Motion was rade by Gertrude Ferriday to allow her. Burke, under the emergency <br /> conditions , to put in a row of hay bales staked, snow fencing , thea another <br /> row of hay bales at the foot of the bank and request ars immediate filing of <br /> a Notice of Intent, SECONDED & VOTED. <br /> It was agreed hay bales can also be placed 25 feet across the top,, not on the <br /> edge ofthe cliff, at an angle , horsesho d. <br /> It was noted there is an enforcement order on the property which must be sat- <br /> isfied <br /> atisfied prior to proceeding. <br /> Dr. Edwin M. Kendricks , SE 43-591 , Cape Cod Landscapes - Agent. Stephen Vantol <br /> stood down for this hearing and presented. To do planting and patio location at <br /> Cottage 634, Maushop Village, Mr. VanTol advised this was informally done before <br /> but there was a question of filings. An Order of Conditions is necessary to pur. <br /> sue what the applicant warts which is the issue of forward of the bank. This is <br />
