Box 208 <br /> Mashpee, MA 02649 <br /> 1 . .Q.E. # 4 -316/tiara Shell Road <br /> Mau hop ill ge 11cw Seabury <br /> Dear Mrs. Studley: <br /> I am writing to you for the purpose of requesting written clarification as to my involvement <br /> in the matter of Mashpee Conservation Commission vs. New Seabury Corporation, <br /> being Docket Number 44404, pending in the Barnstable County Superior Court. <br /> Your letter to me under date of October 11, 1984 specifically requested that I not conduct <br /> any negotiation or activities without express written advance approval by the Conservation <br /> Commission and further, that all subject matter pertinent to the case which had been <br /> accumulated by me and my associates was to be placed in the hands of Joseph Murphy, <br /> Executive Secretary no later than Wednesday, October 17, 1984. with reference to , . <br /> this latter request, i have complied, and delivered my entire file contents to Mr. Murphy, <br /> who In turn, I believe, delivered them to a member of your Commission for transmittal <br /> to the law off ice of Gre or L McGregor regor ire Boston. <br /> At the present time I do not have in my possession all of the materials I accumulate <br /> because, as I have indicated herein, I complied with your request of October 11th and <br /> delivered them to Mr. Murphy. In addition, I have refrained from engaging in any negotiation <br /> or activity concerning the pending litigation, with the exception of reviewing the Answer <br /> and Counterclaim forwarded to me by Attorney McGregor, making corrections to the <br /> same, affixing my signature to the same and filing it with the Superior Court. <br /> It is my understanding from Selectman Richard 'Derry that the Conservation ommis lon <br /> now desires me to go forward with representation of the Commission in the pending <br /> litigation. I have received no written confirmation from your Commission of this request,,- <br /> and <br /> equest,and I ani very reluctant to become involved in the case again unless I do receive some <br /> form of written com m unic tion from you. I do not intend to be officious, but I must - <br /> Insist upon some form of communication in view of the express instructions set forth <br /> in your letter of October 11, 1984. <br /> It Iis my further understanding that the New Seabury Corporation has filed a new request <br /> for determination and a bearing was scheduled for December 13, 1984. 1 did not receive <br />
