Mr . Clark said <br /> that the tank could be shifted, - <br /> Mr. Clark suggested that the basin be moved away from the easement, <br /> He also suggested a pole . Mr. Clark stated that this is really not <br /> within the jurisdiction of the Conservation Commission. <br /> Martina Anderson and Virginia sea. er , abutters having properties <br /> behind the I ocera property, were present and voiced their objection <br /> to the project. The primary objection was that the structure should <br /> be limited to one building and not two . Chairman Studley informed <br /> them that it was one structure being joined by a deck and a trellis . <br /> Chairman Studley said that the meeting tonight is to decide whether <br /> or not the Petitioner has covered all the means of controlling this <br /> erosion problem insofar as his own lot is concerned. "According t <br /> the plans that have been presented here tonight, that is controlled, " <br /> she said. she said, "They are satisfactory to the State and the <br /> State has asked us to make our opinion known in the matter. It is <br /> our responsibility to make an Orden of Conditions under the Town <br /> By-law, The State has superseded our original order. we denied it <br /> under the Town By-law so we have to either modify that denial or <br /> P sue an order of Conditions ." <br /> Ms . Anderson brought up damage to her property from eroding factors <br /> on the Iocera property. She was advised. that any complaints that <br /> any abutter or any person may have may be made a. lawsuit if that <br /> party so desires , <br /> Chairman Studley proceeded to read the last four orders of ' s <br /> Superseding Order of Conditions : "All roof run-off shall be directed <br /> into gutters and downspouts and directed into dry wells , Dry wells <br /> shall be constructed and located as shown on the plans at 2/7/85. <br /> w Ails shall be 61 x 41 standard free-cap leaching basins surrounded <br /> by 2' of stone . Dry wells will be constructed and maintained so <br /> that the stability of the coastal bank will not be adversely affected , <br /> r Surface run-off shall be directed away from the coastal bank and the <br /> bank' s intersection with the gravel driveway also known as the "clam <br /> shell" road and directed int dry well No. 3 as shown on the 2/7/85 <br /> Plans . The dry yells shall be constructed with 8 cubic yards 6,xl2lx 3 F <br /> of 3/411 ' to 1 1/2" crushed, washed stone , The top of the coastal bank <br /> - <br /> and the area behind the, bank will be re-vegetated as shown on the dans <br /> with rosa rugos-a, beach grass and other indigineous plant materials at <br /> post-grading contours in order to maintain the stability of the bank <br /> and to reduce impacts of rainfall. The sod, located easterly of the <br /> proposed dwelling shall be removed and re-planted with indigi .e o s - <br /> sPecies of plant materials beach rose and beach grass , The Applicant <br /> shall cooperate with the New Seabury Corporation to ensure that the <br /> M <br /> 1 <br />
