•
a
TOWN OF MASHPEE
CONSERVATION COMMISSION
J#
P.O. BOX 208
MAMPEE, MASSACHUSEITS 02649
Hearing was held on October 2 , 1985 before the Mashpee Conservation
Commission for the purpose of determining whether or not an emergency
situation exists at Maushop Beach, New Seabury, Mashpee , Massachusetts
as a result of recent weather conditions effected by the Hurricane
Gloria on or about September 27, 1985.
The hearing was requested by the New Seabury Corporation. Represent-
ative for the Corporation at this hearing was Peggy Collins of BSC/
Cape Cod Survey Consultants, 3261 Main Street, Barnstable , Mass.
Present for the Commission were : March duPont, Chairman;a.n; Pauline
ebory, Vice Chairman; Louisa ehrma ; E, Stuart Peoples and Elliot
Rosenberg.
At the commencement of the hearing, Chairman duPont stated; "This
hearing has not been posted in accordance with the ' open meeting law!
and it will be limited to evidence to establish whether emergency
conditions exist"
Ms . Collins stated, "We are here requesting permission from this
Commission to nourish the Maushop Beach which has been severely eroded
s a result of Hurricane Gloria, severely eroded to the point- of
there being, at the site , an emergency situation where the cliffs are
overhanging and unstable , As you know, this relates to the civil
court case or the evil action No . 4440and simply, as stated, we"
would like permission to go down and using the access known as the
' clam-shell road' and place a minimum of twenty-thousand cubic yrds
of compatible sand on that beach. As you know, those of you who have
seem it 1 have some photographs to show it to you) , since the Hurri-
cane there is erosion not only along the bank but the head of the road--
way, clam-shell roadway, has been gullied and some fill will be re-
quired there simply for accessing the machinery that would have t
dump the sand or cart it down the beach,"
Chairman duPont: "What was the amount of sand'
s . Collins : "Not less than twenty-thousand cubic yards . I'm taking
wording directly from the Motion to Modify the Restraining Order. I
think we all ought to be consistent with the wording. It has been
calculated by engineers at New Seabury to be somewhere in the mature
f twenty-thousand to thirty-thousand cubic yards actually needed t
go in and fill the holes that have been created. But the wording that
went to the court is 'not less than twenty-thousand cubic yards' *"
Ms ** l r annn,: "So, that's a minimum amount."
Ms . Collins : "Yes"
