.ashpee Conservation Commission
Meeting of January 8, 1987
Page .
Mr. San i k i stated this prop'osa l does not violate any town zoning or regulations .
Mrs . Marsters stated if a zoning variance was granted to set the house back
this could be done without moving the septic . She further stated it would
be more desirable to go for a variance than to build on the top of the bank.
Mr. Sari i ek i stated tine back corner of the building will be the only thing into
the bank and tha t corner i s 95 feet back from the waters edge w th ars encroach-
ment on the water of 5 feet.
Mrs. Marsters stated i t 'is not the d i tante from the water , it is on the top
of the bank. She expressed further concern when it was stated a walk-out
basement is proposed.
Mr. San i k i stated a 5 foot work l lm i t is proposed around the building wi tb hay
bales installed. a t the top of the bank and at the well site to keep sediment
from entering the pond. To further stabilize the bark, d rywel l s are proposed
on the corners of the building . A pervious driveway is planned. A contain-
ment structure is proposed on the west side of the house.
Mr . Roserbe ra stated the leaching be going down onto 2061 due to the
slope. The top of the ground a t 82 feet on 2061 is going to be below the
containment wa 1 1 . Mr. Sa n i k i stated the containment wall goes down 8 feet
and wi_ 1 1 be at 72 feet. The abutting property where the leaching pit is
going is approximately 82 feet over the property 1 i rye and does not drop to
o feet unt i i at the street .
Ms duPort pointed out this is a Board of 'Health mater.
Mrs . Ferriday to ted the containment wa 1 1 is going right over to the house
and it is an assumption that it should go right 83crass the abutting property
to do its job. The containment wa l 1 is at the top of the bark and the entire
bark will be disrupted.
john question how the measurement from the edge of the pond to the house was
arrived at and Mr . Saricki stated all measurements are on a horizontal plain .
Concerning the kve 1 l , he advised it wi l l be dug by hand with a tripod and
weighted sledge. He further advised the plan is or, fila with the Board of
Hee 1 th and State and if there is a problem with obtaining f'or the
septic and containment wall this structure ill not be built . He did not see
any problem with the Board of Health issue.
Mrs . Marsters stated she i s greatly concerned with the top of the bank and
would prefer they go for a variance to move the house back. It is her feel i ng
it would be relatively simple to obtain a variance. She referred to the cott-
ages
ottages at New Seabury which are not al lowed to walk within 50 feet of the top
of the bank and th i s project requests a wal kout basement at the too of a bank.
Mr. Rosenberg agreed.
