Mashpee Conservation Commission <br /> Meeting of January 29, 1987 <br /> Page 7. <br /> The driveway is to be of pervious material . A single row of hay bales 10 feet <br /> around the house is proposed and roof drains at the four corners of the dteelIing . <br /> The water service can be hand dug . Excess fill to be removed and no grade changes <br /> in the driveway are proposed. <br /> Tom Young , an abutter at Lot 154, stated he has lived there for 15 years and the <br /> lot at full moon high tide is waterfront. In the spring the fish spawn in the <br /> area. The run-off from the property will be into the marshland . On three sides <br /> is conservation land and the town should take the property by eminent domain. <br /> He further advised clamming was just opened after one year of pollution in the <br /> area . He stated he is adking the Commission to deny the request. <br /> John Stated he saw no reason why the project cannot be denied. He advised it is <br /> 120 inches at the test pit to ground water at the 14 foot contour. <br /> Mr. Sanicki stated Pirates Cove is an old subdivision and cannot comply with <br /> Title V today. They are preparing a system in accordance with Title V. The <br /> house is outside of the flood plain as defined by federal requirements . <br /> HEARING CLOSED <br /> John presented four articles for Annual Town Meeting for the purchase of land <br /> for conservation purposes . <br /> After discussion: <br /> VOTE: M:ccion made and seconded the `our articles ;attached) be submitted for <br /> inclusion in .the Annual Town Meecing ,warrant . Unanimous . <br /> He also aavised Doug Boyd has ,corked out a transfer of open soace with Fox Hill , <br /> South Sandwich Road, if the commission .ants to add to conservation land . Mrs . <br /> Marsters questioned the legality and Mr . Boyd ' s authority to arrange a transfer. <br /> This matter would have to go before the Planning Board . <br /> A request was received from the lawyer of Mr . Berkowitz for a change in the <br /> denial under the bylaw for the revetment as they have a suoerceding order from <br /> DEQE. It was noted they filed an appeal with DEQE and the Commission did not <br /> respond. The house does predate the act. <br /> Ms duPont stated they do have an outstanding Order of Conditions not complied with. <br /> They are entitled only if they have exhausted every other means befine going to <br /> hard engineering . She stated she is not in favor and this should be denied under <br /> the town bylaw. <br /> Certificates of Compliance issued: Steven Wiener, 9 Tide Run; Colonial Gas Co. , <br /> Great Neck Rd . ; Robert DeMichele. <br /> Orders of Conditions issued: Seymour Yanoff; High Wood Water Co. ; Colonial Gas <br /> Co. <br />` The meeting was adjourned at 10:45 p.m. <br /> Respectfully submitted, <br />
