Conservation Commission
meeting of- April 1 , 1987
Page 2.
Comments - Continued: Ernest Roberts stated he has no objections to what M r.
Sullivan i proposing tonight except that any trees , unless dead, should not
be removed. He would not object if there is no intention to disturb the bank
and no sand is brought i n,
Shirley Peters asked to view the map. She asked if the other area was supposed
to serve the residents of Mashpee Shores . Mr. Sullivan stated they are at opp-
osite
p-
osito ands of the development. Mrs. Peters stated as Mr. Sullivan has been
f i l l i ng in land that should not have been filled i n and has built a house that
Is too close to the grater, she would be very much against going ahead with this .
Joanne Ferragamo questioned what was at the end of the steps and was advised
it is all natural ground. She questioned the number of people using the area
and whether it would be excessive. Mr . Sullivan stated there are 54 house lots
with deeded rights.
Jim Shrug re , abutter, stated he was in favor. There is another- beach further
down which is used and he estimated only a dozen families ou l d use this area.
,Judy Mills questioned the need for another beach at this development as it has
one beach and abuts Attaqu i n Town Beach. She further stated that because it
1s marked "Reserved Area" on a plan does not mean tape down all the trees and
put in a beach, it is only to reserve open space within a development. Mr.
Sullivan stated there is open space, there are two green areas and two beach
areas. Ms Mills stated one of the green areas is totally under water, the
swamp that Mr. Sullivan devastated . Mr. Sullivan stated , for the record ,
there are two green areas and two beach areas . This happens to be a beach area .
Mrs . Jacobson stated Chat no one has determined it to be environmentally sound.
Mr. Roberts stated he has been there 15 years and there are four "Reserved
Areas"- one a swamp Mr. Sullivan filled i n , the other a reserved area at the
far end which he Inas made into a beach , another reserved area at the junction
of Magnolia Lane and Birch Way which he has partially filled i n and another
reserved area .
Phyllis Pas fou s kas stated while walking around the area as a layperson she
noted a lot of erosion in various places . The primary and only consideration
should be the health of the Mashpee River which already has problems which the
town. is trying to correct.
;Ray Peters questioned the erosion from the top to the bottom of the stairs .
Mr. Sullivan stated 1 t is only a stairway sitting on a surface. Pressure
treated wood will be used, it will be hand dug. The root structure surrounding
will not be disturbed. There will just be treads on the steps . s Behrman
expressed concern with the edge of the bank.
Judy Mills suggested the Commission consider the cumulative effects of this
project. We do have the swamp not well filled a s seen from route 130, the
road drain going into the Mashpee River from Redwood Circle causing enormous
s i 1 to t r on. He already has a beach and this seems above and beyond the call of
this town to provide private service for private developments .
Ms B h rman questioned what is proposed to keep people from destroying the veg-
etation
B-
etation at the edge of the bank. Some mechanism must be arrived at to, keep to a
minimum the impact on the root structure.
HEARING CLOSED - ORDER of CONDITIONS IN 21 DAYS .
John will spear with E. Virgil io con -
