Any disturbWo <br /> ance of vegetation on the upland side will be restored and reve a tared <br /> after construction. A stairway will go up and over the vegetated wet- <br /> land area leaving a 6 foot space beneath. <br /> Ms Behrman questioned access to the lot stating there is no house on <br /> the lot and noting the three car parking area with only a smallpath- <br /> way to the stairs, she questioned whether clearing is proposed, <br /> - r. A copy of the <br /> Board of Appeals decision will be provided. to the Coarmission. <br /> Ms Behrman read two letters into the record, the first from Dr . <br /> Richard M. Cushner, -an abutter on the south side, who is strongly opp- <br /> osed to the project. The second letter of opposition was from Mr. M.S. <br /> Click, Lot 6 . Copies of these letters were also seat to the Board o <br /> Health.' <br /> Mr. Kirrane stated they are addressing issues that are not before the <br /> Board. He further stated the dock would not have any more impact than <br /> the 102 foot dock belonging to Or. Cushner. <br /> Ms Behrm an stated the issue of potential storage of boats was raised <br /> and Mr. Kirrane stated there is no intention to store boats on the <br /> property. Mr. Sanicki stated this can be addressed in the Order of Cond <br /> ditions as a stipulation. <br /> Mr. Ki rrane advised the Boat House originally proposed has been aband- <br /> oned. They are only requesting what is shown on this particular plan. <br /> Concerning the law suit referred to in Dr. Cushner' s letter, this re- <br /> lates to the decision of the Board of Appeals and is not within the <br /> purview of the Commission. Action can be taken not withstanding the <br /> fact the law suit exists and if it is determined the Board of Appeals <br /> exceeded its authority# any action taken by the Commission would be <br /> mute. The Board of Appeal ' s decision has been appealed by the abutters <br /> The Chairman opened the heari.ng ,to comments from the public. <br /> Dr . Cu hn r stated his pier is not 102 'feet Iong.
