Where a proposed activity Involves the removing, fillein, <br /> dredging or altering of a Banc, the issuing authority shall presume that <br /> 18c afij is significan to the interests specified." move <br /> Ilenera 1 Performance Standard. <br /> (a) Where the presumption set forth above is not overcome, any proposed <br /> work on a Bank shall not impair the collowing; <br /> 1 , the physical stability of the bank. <br /> The existing stairway down the property already the site f an erosion <br /> problem. if I am to understand the applicant correctly, they will be <br /> replacing the e istiong steps with wooden timbers and doing 'some re- <br /> vegetation. <br /> The slope of the upland property contributes to the runoff problem down <br /> the bank and I do not see this project as a solution to this problem, <br /> I believe that the disruption of the bank to place in timber steps would <br /> decrease the stability of the Bank by loosening the soils and disrupting <br /> root systems. Without designing the project I would suggest an elevated <br /> stairway, with plantings and some fill where necessary) held down <br /> • with a biodegradable fabric to keep the bank stable while the root <br /> structures take hold. The upland area should be looked at for possible <br /> measures to control the amount of runoff. <br /> As the project has been presented I would suggest a Positive Determination, <br /> Trustees of Reservations- <br /> The path will be out through the buffer zone along the Mashpee River <br /> and rear Trout Pond. <br /> "Activities Within the Buffer Zone: Any activity proposed or undertaken <br /> within 100 feet" of a resource area" which in the judgement of the <br /> issuing authority will alter an Area Subject to Protection Ander the Act, <br /> is subject to regulation.# .11 <br /> The 41 wide path in ray opinion will not have an affect on the resource <br /> areas. <br /> The two ramps proposed to cross the brooks fall within CMP 10.55 <br /> Land Under Water Bodies and waterways, and 10.54 Banks. Without <br /> foot ramps to pass over these areas erosion will occur from foot <br /> 4 traffic.
