Conservation <br /> commission <br /> July 1 , 1988 <br /> Page 1. <br /> Cummings Dock: fir. and Mrs. Cummings were present and, stated they were <br /> there to give any information necessary. <br /> Mrs. Ferriday advised the hearing is closed. and the Commission can <br /> take no further in format i-on#, <br /> Mrs. Ferriday stated three;- commissioners went out .additionally, - to <br /> look, at the 7foot. dock. She showed pictures of Mrs. Jacobson and- Ms <br /> eh rm an in the water where the end o f, the -float i , proposed* The tide <br /> had turned a eouple of hours--and- was showing about- 17 inches. The <br /> problem is whether.-there _ is enough area for-.this IIoat -to IIoat. <br /> Li sa stated i t - is- go ing- to be -going- up and. down w th the- -t i des. The <br /> posts that . are,. going -to -.-be. holding the -dock up and the- floats and <br /> posts supporting the dock are going to be taking up shellfish i <br /> habitats. <br /> 1 <br /> a' Coffey stated the ' Commission heard significant testi onr that -this <br /> � <br /> was_ a shellfish habitat that was going to, be adversely - impacted. <br /> Mrs. Ferriday advised a neighbor -was, questioned about a mooring there <br /> that could not be -very- far from - the.-northwest- corner of the float. - The <br /> Environmental Impact -study- did not- address -any effects that-. wou -d 9 be <br /> caused by this structure. <br /> Starting with the steps; <br /> Lisa. stated it is actually a sloping ramp from the- top of the wall to <br /> the. top of the dock. There are no steps - there now. <br /> Mrs. Ferriday suggested the project should be denied andL ,the applicant <br /> resubmit. Lisa suggested to deny but woad it -to allow them to come in <br /> with another proposai. <br /> - r. Rosenberg suggested Mr. Cummings might wan-t to talk about it or <br /> withdraw without- prejudice and -submit a new plan, He explained this to <br /> Mr., Cummings, <br /> Lisa stated the he was officially closed at a public hearing. She <br /> stated the Commission would have to come up with either yes or no. <br /> i <br /> Mr..'.-Cummings stated or - it could be--done with. Gond i t i ons and one o f , <br /> those could be- to build the dock without the float. <br /> Lisa stated this would be entering new information without advising. <br /> Mr. Rosenberg stated the Commission can alter the plan and sayY ou - . - <br /> can <br /> build X but not 1� and he did not - suggest the hearing be kept open <br /> but,-%at - the- request- of - the '.app- -icant, -=the 21 day period- can be extended <br /> to give the applicant aq chance to make further suggestions to the <br /> - Commission which they may. or- may. not -accept, as an alternative to v a <br /> denial and starting all over again. It is obvious we are not going <br /> to give him this. <br /> Mr. Cummings stat-ed, he believes the Commission cannot -expand on this <br /> without a new public hearing but can grant a part of its Mr. Rosenberg <br /> agreed.
