BOX 208 <br /> MASHME, MASSACHUSS 02649 <br /> i <br /> I <br /> Preamble. 10.54 1 <br /> Bonin: "Banks are likely to be significant to public or private water supply, <br /> to flood control , to storm damage prevention, to the prevention of pollution <br /> and to the protection of fisheries and wildlife habitat. Where Banks are <br /> totally or partially vegetated the vegetation serves to maintain the <br /> Barks stability, which- in turn protects water quality by reducing erosion <br /> and si t tion <br /> 10.54 3 <br /> "Presumption. Where a proposed activity involves the removing, fillein, <br /> dredging or altering of a Bank, the issuing authority shall presume that <br /> 18c94 afil is significan to the interests specified." (above) <br /> "Genera l Performance Standard. <br /> (a) There the presumption set forth above is not overcome, any proposed <br /> work on a Bank shall not impair the collowing; <br /> .1 , the physical stability of the bank, <br /> The existing stairway down the property already the site of ars erosion <br /> problem, If I am to understand the applicant correctly, they will be <br /> replacing the existing steps with wooden timbers and doing some re- <br /> vegetation, <br /> The slope of the upland property contributes to the runoff problem down <br /> the bank and I do not see this project as a- solution to this problem. <br /> I believe that the disruption of the bank to place in timber steps would <br /> decrease the stability of �the Bank by loosening the soils an disrupting <br /> root- systems,stems. Without designing the project I would suggest ars elevated <br /> stairway, with plantings and some fill where necessary) held down <br /> with a biodegradable fabric to- keep the bank stable while the root <br /> structures take hold, The upland area should be looked at for possible <br /> measures to control the amount of runoff. <br /> As the -project has been presented l would suggest a Positive Determination, <br /> Trustees of Reservations: <br /> The path will be cut through the buffer zone along the Mashpee River <br /> and near Trout Pond. <br /> "Activities Within the Buffer Zone: Any activity proposed or undertaker <br /> within 100 feet" of a resource area" which in the judgement of the <br /> issuing authority will alter an Area Subject to Protection Under the Act, <br /> is subject to regulation.. ,11 <br /> The 4' wide path in my opinion will not have ars affect on the resource <br /> areas. <br /> The two ramps proposed to cross the brooks fall within CMR 10-56 <br /> Land Under later Bodies and waterways, and 10.54 Banks. Without <br /> foot ramps to pass over these areas erosion will occur from foot <br /> traffic.
