Rosenberg stated where this is in an ACEC zone, the question is to <br /> the propriety of allowing a bulkhead; it will be answered by DEQE., <br /> Mr . Sanicki advised DEQE told him the bulkhead was not allowed and <br /> there was correspondence this was in a velocity. zone, he clarified.. <br /> this and a DEQE number was issued. The house was built in 1980 and an Order of Conditions <br /> were issued just for the pier; at the time, he understood you did not <br /> have to get the float permitted. The Order of Conditions did not in- <br /> clude a float. The original is shown by the dotted. lime and., i - all- <br /> that was authorized. The Hoars. purchased, the house in 1980. He- owned <br /> 3 " boat and, in 1981 or 1982 he had the float put in. Mir. Hoag died <br /> last year and Mfrs. Hoar is attempting to sell the. house. The, float. is. <br /> put in every year. There is no Certificate of Compliance. <br /> Mr. Rosenberg asked if the dock was in at the time the Hoars bought <br /> the house wi thout a- Cert i f i Bate of Comp Ii anc . Mr. Dubin- aid- no.,,. it <br /> was being constructed and it went in some time after. Certificates <br /> were few arra far between in the early ' 80's. r; Rosenberg- asked if <br /> the Order was recorded and was told it was. <br /> Mfrs. Jacobson asked if the dock was put in in a different location <br /> than 'shown on the plan. Mr. Dubin stated a different length. ant.- differ <br /> ent location. There is no float now and this- gets us to- late 1987 when <br /> Mr. Hoar was still alive, New Seabury Corp. procurred a buyer. The-. <br /> house went under agreement in the fall of * 8 . In the Spring a ' , <br /> the prospective buyer investigated the dock to, make sure all approvals <br /> were there and discovered the float was not authorized* He came to the <br /> Commission and the float has been removed. The parties have a. hold- <br /> back type arrangement and they. are looking to see If the Order can be <br /> e nded to the way the dock actually is. It is compatible with the <br /> rest of the neighborhood ; it is out of the way in- a cave* <br /> The Commission agreed the location of the float is an improvement. <br />
