Hendry stated permission was granted for the house but the contractor has been holding off . He anted if construction could commence on the Douse if the request for the superoeding order for the pool was withdrawn and the pool held in abeyance? He asked for a consensus of the Commission that if everything went through Board of Appeals this would be permitted , Mrs . Simmons stated if for some reason it didn ' t , the Commission could write DQ . It was suggested th,e chairman contact Elliot Rosenberg and Pat Caffey by phone tomorrow for their feeling on the ratter and . Hendry to be contacted with the results . Ms . Dehrman was Chairman Pro Tem for the remainder of the evening 7 : 30 Roubert F . Spousta . To rebuild a wall on the shore of Johns Pond ( Sakonnet Drive) in front of 40 Ninigret Ave . She called attention to the plans whereon it was noted there is a boudary marker which was not visible at the site . She requested he place a stake at the marker . Mrs . Jacobson asked if he was planning t do more or just what he has done? Mr . Spousta painted to a section and stated it has been in so long without any iron that it is deteriorating , where the individual pieces are . He advised the drive has eroded some 12-14 feet in the last 25 years ; that ' s why he built the walls . Mrs . Jacobson asked if the actual walls were on his property and he stated no , the walls aren ' t , but the drive was originally out- side of his boundary lines and tho drive kept creeping back so it ' s on his property now . Mrs . Jacobson stated she has the same problem . Mrs . Simmons asked how he legally put a structure on what is not his property? Mr . Spousta stated back in those days there was no Conservation and people were expected to do what they could to hold the shore .
