+ August 243 1989
Pro-posed Regulations
Page 12*
NEIL B S : I am a member of the Harbormaster' s Department but he
speaks very adequately for himself. I prefer- to peak as a taxpayer.
I say, as I attended the meeting down at Cape Cod Community College,
that I didn' t sense that grandfathering was impossible. By the end of
the meeting, there was some indication'-that it would be considered and
I would strongly urge you people to write in your letters of protest
to emphasize that where you have a seasonal thing under the control of
the -Harbormaster, at least that" s one set of facts. But where you
permanent ermanent structures of v-arying degrees of conformity, that they
not forget that the grandfathering is more than desirable to the
majority of our taxpayers.
TONY FII AMMO, RiverRoad: I am happ-y to, ear that if we' re goin
to have a Hoge Rule Cock Bylaw that it will mirror Chapter 91 . 1 am
also concerned that we even have a Home Rule Dock Bylaw for the
reasons of Chapter 91 . 1, think the Commonwealth wants to enact a
e ulation which has been around since the 1 but has now decided
after many years g into an enforcement mode and actually start to
LSI '
with it the bare reasons for doing so. icy understanding is'
what they cant to do is to give all of the citizens of the cocoon-
' wealth access to tidelands and other areas that we all should -have
access to and gnat' s why they have a Chapter 91 license. I don' t
think the Commission should get into an issue that has to do with
public access, I feel the Commission is here to protect the enviro
 me
nt and to administer Chapter 131 and whatever Home Pule Regulations
we, as
a community, feel would be appropriate* I feel the Chapter 91
license program is not so much an. attempt to protect the environment
it is t give the citizens f the Commonwealth the rights to ,water
access and I think if we want to have a hone rule dock bylaw, it
should
e oriented towards protecting the environment and directly
related to 131 and not 914
1 received a handout earlier circulated by the Harbormaster)
that of all the structures n the waterfront in
that suggests
ashpee today may not have Chapter 91 licenses which does not surprise . .
me because there has been a hiatus for many years in which the State
didn' t give 91 licenses.
Does anyone i
the xoom this evening have a feeling for what 90%
of those structures equal in teihs of numbers? Is it 300 cocks, is it '
x anybody taken the time t invento y what 9. %- our
 seawal,ls, has a ►
structures might be in this town . o . Okay, the reason I ask that is
because if
it' s a lar8e number and there' s a limited grandfathering or
amnesty period, let a shorten the whole thing, Iwork under contract
to a-►eral Mate i
agencies; very little - gets none n the course of a
ger* little is really going to get done under 91
week. I have a fear
on the State level in the end. This is just the typical stuff that
goes on every decade or so and a lot of people get caught in the
cracks when this happens. I would not want to see a situation where we have such an overwhelming number of structures that have to be
brought into compliance or processed in a condensed period o time
g
that the ,fob can' t be dome properly , either by theomonwealth or the
Town. I think that before we can talk about grandfathering or an
amnesty period , we should have a handle on the. numbers, both in terms
on the state level . Tom, how many of these
of our community and also
things have to be processed in that period? I would
like to see that
the Mate has the staff t do it before they even enact 91 and 1 would
like to know
that we' re prepared ared o do it too , so we can keep the pair
