Conservation Commission <br /> November 30, 1989 <br /> Page 3. <br /> RICHARD HALPERN: 1 have four questions. <br /> EHRIA : one please, one at a time because we do have a number of other issues <br /> to get through. <br /> HALPERN: This is a public hearing, ars l allowed to have four questions? <br /> SIMMONS: Richard, I said one subject at a time. <br /> HALPERN: one subject apt a t i e, I would like to come back to the other three. <br /> IONS: Absolutely. <br /> HALPERN: I read the article with the interview in the Falmouth Enterprise a week <br /> ago of the Conservation Agent on the proposed bylaw addition. <br /> SIMMONS: l would like to male a correction, before we have any misunderstanding <br /> Richard, l want to make sure that everyone knows these are regulations, these are <br /> not additions to our bylaw. our bylaw, in order to have additions rade to it, has <br /> to be taken to town floor. <br /> HALPERN: That is part of my first question. Lice it said in the article, the <br /> proposed addition to the bylaw. <br /> SIMMONS-0 That was a mistake by Mr. Ott and he apologizes; he will make a correction <br /> I believe in the net Enterprise. There's Mr. Ott, he will answer that. <br /> HALPERN: I 'd rather not debate it right now but get on with my questions. <br /> SIMMONS: Certainly, fine. <br /> HALPERN: I believe he is absolutely correct in what the newspaper said. I <br /> believe that this is a change in the bylaw and is a charge in the intent of the <br /> bylaw. I believe the Commission has the right to make regulations, yes, it does <br /> have the right to make regulations, but I believe that what the Commission i <br /> doing is attempting to rake a regulation that is actually attempting to change <br /> the bylaw. <br /> EHRAI: Town Counsel has reviewed these regulations as to whether or not they <br /> are appropriate for us to take this action on and he has given his approval . <br /> If ,you would care to debate that issue with Town Counsel , you can submit a <br /> written memorandum and we would be glad to forward it to him. Do you have a <br /> specific comment on this regulation that I have ,just read <br /> HALPERN: I have three more, okay? <br /> EHRAN: on this that I have just read? <br /> HALPERN: on this regulation, and I see that Town Counsel approved this but if <br /> you read what Town Counsel wrote, he approved it only as to fora, not as .to <br /> content. What I 'm saying is, this regulation should be a bylaw that should go <br /> to town meeting. <br /> SIMMONS.- This is number 11 , we will take your comment under advisement, thank <br /> you. <br />
