The Chairman called the meeting to order at 6 : 55 p.m. and appointed John Fitzsimmons a voting member . PUBLIC COMMENT PERIOD: None. 7:00 SHIRLEYSILVER for a Determination of Applicability on a proposed pressure treated wall at the top of the slope at 124 Summersea. Road, Steve Waterhouse presenting. Mr . Sherman advised a Negative determination was given for pruning and landscaping. When he met t an on-site , - there were retaining walls with landscape ties . Ile told them no creosote would be allowed.. It is questionable whether permittable as shown on the top of the wank. Mr . Waterhouse stated i t can be a few feet back from the crest of the bank. Asked if d.eadmen will be used on the wall ,, he stated they will . Mr . Sherman asked for a new sketch of the project . The Commission can provisionally accept this as a negative determination if they get prop- erly filled out forms and a sketch. Mr . Waterhouse stated he can show this will not be on the crest of the bank. Mr . Sherman wanted it shown accurately' on a plan where it is located and how high. Mr .. Waterhouse stated it is three to four levels high, two feet . The wall will come to an end where lawn will be tapered down to natural grade on both sides . He will put the corners in, if there is a dnager of washing. Mr. Sherman stated prior to leaving the site he should call hien so that he can go to the site and check. Mr . Waterhouse revised the plan. Public comments were requested : none . VOTE: Motion made and seconded to find a Negative Determination wending receipt of information requested and with the con- dition that the agent look at the slope to make sure it is properly staffed. and at the end of the project to make sure everything that can be done has been done . The house was under construction and as it proceeded it was desired to have a deck Which would be closer to the work limit 8 feet , 33 feet from the top of the bank. Mr . Sherman stated it could be perniitted with the condition that the area disturbed is to be well vegetated, which was not called for. The disturbance is closer to the buffer and should be reveg etated with enhanced revegetation. A 50 foot buffer to the salt marsh is fine for pollution but not for wildlife habitat ,
