NASHPEE CONSERVATION COMMISSION <br /> Minutes of September 22, 199 <br /> commissioners present: Frank Homeyer, John Fitzsimmons, Paul <br /> A rerett, Marry Des ros i ers, Sus ana <br /> Lannik. <br /> The meeting was called to order at P.m e <br /> PUBLIC COMMENT PERIOD: Neil Besse came before the <br /> Commission with regard to Fells Pond and the cranberry Bog, <br /> Jack Fitzsimmons stepped down for this discussion but <br /> reserved the right to speak as a citizen. <br /> Nr. Besse advised there was a filing under S -843 t <br /> permit cutting around the bog, an amended order and then an <br /> extension was granted to permit cutting until 1996. A <br /> neighbor was against this. They were stall operating under <br /> the old original permit with modifications, He does not <br /> represent the committee of Fells Pond Peninsula Council he <br /> represents seven abutters. He has talked with Chris Burden <br /> who is in favor of mowing the bogs. It was decided to refile <br /> and drop the request to mow along the edge, which seems to be <br /> causing all the problems. <br /> They have received letters from the Fire Chief that mowing i <br /> a good idea. It also helps with the mosquito problem. They <br /> have never crossed the ditch, as requested by the Commission. <br /> Property values go clown when the bog grows up. It was <br /> thought that it was common ground. Fish & Wildlife will be <br /> taking over the bog at some point, He would like to file for <br /> an extension and deleting the request for rowing. fir# <br /> Sherman agreed since the permit was issued and not recorded, <br /> the Commission could delete any reference to mowing. <br /> Mr. Fitzsimmons disagreed; the Order of Conditions was <br /> granted to the Peninsula council and this is another group of <br /> people, He did not feel it could be amended if it is <br /> different party. Mr, Sherman asked who is responsible? <br /> Mr. Fitzsimmons ns stated the Peninsula council is not <br /> supporting any further cutting, <br /> Ms Lannik asked, if the order is amended and it was recorded <br /> and the bog is {then transferred to the State, would the state <br /> be obligated? They would be attaching this to property that <br /> the applicant does not own. <br /> Mr. Sherman stated this was done with New Seabur is <br /> permission. The applicant was Peninsula council and the <br /> owner wag New Seabury, <br /> Ns Lannik stated it has to be recorded against the property <br /> and becomes part of his property rights. She expressed <br /> concern. <br /> Mr, Sherman stated it is agreed they are not cutting that <br /> part any more. <br />
