1 AS P E CONSERVATION COMMISSION <br /> Minutes of October 20, 1994 <br /> Conmissioners present: Gertrude W, Simmons-Ferriday, Frank <br /> Dome yer, Harry Des ros i ers, John <br /> Fitzsimmons, Robert Lopez . <br /> The meeting was called to order at 7:00 p,m, <br /> PUBLIC COMMENT PERIOD: None, <br /> 7:25 DAVID W, OAMON for a Determination of Applicability on <br /> the removal of plant material at 89 WhippoorwillCircle. <br /> Mr. Sherman advised this is flat Land Subject to Coastal <br /> Storm Flowage. They had to remove shrubs growing into the <br /> cesspool . It is located 110 feet from the salt marsh an the <br /> street side. <br /> Public comments: none. <br /> NOTE: Motion -made and seconded to find a negative <br /> determination. <br /> NEGATIVE DETERMINATION, <br /> 7:30 GEORGE WYSHAK to license and maintain an existing wood <br /> pier, ramp, float and bulkhead along Popponesset Creek at 160 <br /> Waterway, Dave Sanicki presenting. Abutter notification was <br /> provided. Everything is existing and is pending an interim <br /> permit. The shellfish officer questioned ned loc tion. The <br /> bulkhead is filled right back to it; it protects the <br /> shoreline from tidal waters. <br /> Mrs. Ferriday. stated she knows the wyshaks and will step down <br /> if the, C mmission or wyshaks would like her to, Both agreed <br /> she should sit for the hearing. <br /> Mr, Sherman stated it is an innocuous project and would <br /> recommend conditioning when the wall is replaced in the <br /> future, them should he anon-site inspection with the <br /> Commission. <br /> Mr. Sanicki stated it can be conditioned wall reconstruction <br /> requires another filing, <br /> Mr. Sherman asked if the tree cut down is shown. Mr. <br /> Sanicki advised the tree by the deck is shown on the plan4 <br /> the stump was infested, He has another proposal to upgrade <br /> the septic and add a garage. <br /> Mr. Sherman stated under the violation notice he must come in <br /> and file for removing that tree, before next spring. <br /> Mr. Sanicki advised he did not get a soils test because o <br /> the steepness of the yard but aces intend to come hack to the <br /> Commission; it has not been forgotten. <br /> Nor. Sherman stated if the filing for the house is not in by <br /> April , the Commission will require a filing for the tree. <br />
