_ 1 <br /> AFTER HEARING AGENDA <br /> BA SORT HOMES: They wish to change the driveway. The Agent <br /> did not feel it was important enough to hold a public <br /> hearing. It is further away from the wetland, He suggested <br /> moving administratively. <br /> VOTE: Motion made and seconded to issue an amended order <br /> administratively to Bayport Homes for SE 43-1242 . <br /> LUCONI - DOCK; The Order of Conditions limited him to one <br /> boat, on the outside. Mr. Luconi appealed. There was a site <br /> meeting with DEQ' and DMF and there may be a resolution. <br /> Holmes & McGrath proposed moving the float out longitudinally <br /> and put a boat on each side. <br /> Mr. Sherman suggested if the Harbormaster goes along with <br /> this proposal, the commission could accept it. He suggested <br /> amending the order administratively. A letter and plan is <br /> forthcoming. The Commission agreed. <br /> VOTE: Motion made and seconded to accept the proposal by <br /> Holmes & McGrath for the Luconi dock if the Harbor- <br /> master goes along with it and a letter- and plan is <br /> received. <br /> JACOBSON-FINE: sawdust was dumped in the marsh which has been <br /> totally cleaned u . The consensus was if he would perform <br /> community service the fine would be waived. The went <br /> suggested he do some work at the Mashpee River or take some <br /> photographs. <br /> VOTE: Motion rade and seconded to have Walter Jacobson <br /> perform a days work for the Town and the Commission <br /> will waive the fine. <br /> Mr. Lopez was concerned with the concept and Mr. Fitzsimmons <br /> also was not comfortable with this. <br /> The Agent stated the fine can be issued if he defaults. <br /> HIGH SCHOOL: Communication from the Cape Cod Commission <br /> reviewed. They are asking that alternatives be developed t <br /> ensure that no net addition of nitrogen occur within the <br /> Waqu.oit Bay watershed. <br /> The Agent advised they are going with a state of the art <br /> septic that may reduce levels dawn to zero. <br /> Mr. Lopez asked about the ball fields and was told there are <br /> three fields in the plans now. <br /> EDGAR LEAF: A wall was put in without a permit; DEP ordered <br /> it out and it went to adjudication. Apre-hearing conference <br /> was scheduled without proper notice to the commission. This <br /> has been continued to January 18th in Boston. <br /> The Agent advised this is one that should not require <br /> spending -money on Town Counsel because the issue is whether <br />
