A final <br /> Order of Conditions has been issued and unappealed by Mr. <br /> Cohen. Where has been a change in the piling configuration. <br /> Mr, Sherman asked if the design is any different from what <br /> was originally permitted <br /> . Direorio advised changes are on page two. The old plan <br /> called for ten pilings for a 52 foot boat; there is no change <br /> in the number pilings. The old plan called for seven 111 <br /> diameter and three 811 which is now changed to four 1211 and <br /> six 811 . Where is less disturbance to the substrate. The <br /> original plan called for two sets of batter piles 20 feet out <br /> in Popponesset Creek, With the new plan, these have been <br /> moved parallel with the outer -line of the float. Tie-up will <br /> e starboard side. <br /> There was concern expressed by the Harbormaster for <br /> navigational reasons; this addresses those concerns. It was <br /> 132 feet across the creek to pilings and is now 153 feet and <br /> comes no closer to the abutter pier and float, it is still <br /> 195 feet, Neither purpose or scope of the project has <br /> changed. <br /> Mr, Homeyer advised the Harbormaster had no objection, as far <br /> as navigability, but wanted the piles painted white. <br /> Mr. Sherman stated the performance standards are the same as <br /> the State; the Commission is bound to accept this, <br /> Mr. Cohen agreed with the program but is not happy with it, <br /> only as a neighborly act. He expressed concern with the <br /> safety aspect and asked that it be included in the minutes of <br /> this meeting since there was a coat of quite some size in his <br /> yard and hope that the engineers configured this thing for <br /> safety because when a 2- foot boat ends up in his bedroom or <br /> his children's bedroom, it could be a problem and that is a <br /> very big concern of his. <br /> Robert Darn, 51 Popponesset Island Road, an abutter, was <br /> present. <br /> Deborah Sisson, an abutter, stated the plans are not true in <br /> the sense that her seawall and dock are not licensed; they <br /> are. Her concern is that this finger gets clogged up as it <br /> is and is concerned with a 50 f , boat coning in every day <br /> and pushing silt in. Gasoline tends to sit down in there if <br /> there is not a good flow with the tide. As it is, she has to <br /> core out on an angle with her boat. <br /> Mrs, Ferriday was sure this was addressed by the <br /> Harbormaster. <br /> VT : Motion made and seconded to accept the Amendment to <br /> reflect the agreement reached by the state in the <br /> superseding order of Conditions. <br />
