i <br /> i r <br /> VOTE: Motion made and seconded to close pending OP and <br /> Board of Health approval and a meeting with the Agent <br /> and Mr. Sanicki re plantings. <br /> CLOSE PENDING. <br /> 8:00 GGP REALTY TRUST to construct a single family dwelling, <br /> garage, deck, driveway, septic system and utility services at <br /> 240 Surf Drive, John Slavinsky presenting. <br /> The Chairman read a letter into the record from an abutter at <br /> 428 Surf Drive. <br /> Mr. Sherman stated, after seeing the site, the plan could not <br /> he found acceptable with a 25 ft, NVBS and no attempt to move <br /> the house Haack. <br /> The Chairman advised this hearing will come under Regulation <br /> #29 and #30 of the Mahpee Code for nutrient loading. She <br /> asked if the Commission wished to have Cape & Islands try to <br /> move the house and present different plans? <br /> Mr. Slavinsky stated it is 25 feet to the work limit set up <br /> to allow work to be dome around the deck. There was an Order <br /> of Conditions on the lot under the name Miles which has <br /> expired, The lot was resurveyed; the lot is too small. <br /> Mrs.' Ferriday suggested eliminating the deck, <br /> Mr. Slavinsky advised zoning is 30 feet for septic; it has to <br /> he in this location or they cannot obtain the 100 foot <br /> needed. Mr. Sherman stated they could get a variance. <br /> Mr. Slavinsky stated leaching has to be 25 feet from the <br /> catch basin; leaching and reserve have to he 10 feet. House <br /> has to be 20 feet from the foundation to leach pit. <br /> Mr. Sherman stated they could go another 10 feet hack with a <br /> variance from the Board of Appeals. <br /> Mr. Slavinsky stated the actual distance from the wetland to <br /> the house is 43 feet; they cannot do any better and cannot <br /> get closer to the leach pit. <br /> Mrs. Ferriday suggested moving the house to the side and was <br /> told 15 feet is required. Mr. Slavinsky stated 15 feet i <br /> required. In the recent past the concern has been nitrogen <br /> loading. He proposes to change to a two bedroom house. He <br /> would he happy to cut the deck down. <br /> Mr. Sherman suggested moving the tank closer~ to the roam. <br /> Title v states 25 feet from the catch basin.
