Mrs. Ferriday questioned whey they recommended he be given
another contract, Mr, Homeyer stated it was because the
Executive Secretary insisted. Mrs. Ferriday stated that was
not done publicly.
Mr. Homeyer insisted if the Shellfish warden does not
disapprove something, it is an approval, He did not feel the
Commission should hold up a project for his report.
Mrs. Ferriday inquired whether the service was available from
the Division of Marine Fisheries. The Agent advised it is.
The onus can be put on the applicant but if the commission
can get a free evaluation from the Division of Marine
Fisheries, it should. If it is thought that it does not meet
the performance standards, it should be denied.
The Agent agreed with Mr, Homeyer, Mr. York is not only late
but is inconsistent.
To be placed on the agenda one month from now.
DEN-S. CAPE BEACH: The agent stated they had proposed
building a boardwalk but did they mention a crane?
Mr, Fitzsimmons stated yes, that was discussed a long time.
Mr, Homeyer agreed*
Mr. Sherman suggested prefacing a- hearing with the statement
that work is limited to "Project Type & Description" on the
first page of the Notice of Intent, and; shown on the plan of
record, and; described in narratives accompanying the Notice
of Intent.
A subsequent paragraph would state work that does not conform
to that described above would be due cause to revoke the
permit, order remediation of disturbed areas, order removal
of structures, issue administrative notices, violation
notices and/or enforcement orders, issue fines and/or deny a
Certificate of compliance.
This will be incorporated in the Permit to Access Form.,
VOTE: Motion made and seconded to adopt the statement as
written with the incorporation of appropriate warding
in all Places. Unanimous vote.
SEMINAR: Kopelman & Paige are putting on a seminar in March.
The consensus of the commission was to request that it be
held on March 8 .
CERTIFICATES of COMPLIANCE: The Agent advised there are 887
outstanding. A program is in place to address them.
The chairman stated, as a commission, they should have some
instruction in a work shop on doing a certificate of
Compliance inspection.
NEW SQA URY GOLF COURSE: The Agent advised he went around
the course with Tom Columbo who is initiating an Audubon
program to make golf courses more environmentally sensitive.
